how deep into petitioner's background does USCIS go, and is it legal?

one of reasons of our notice of denial is that my wife noted that she has never used any other names. "However, state enforcement notes the following names: " here goes her first name + her last name, as well as her first name + middle name + last name.

USCIS thinks if you give out first name and last name, it is different than giving out first name, middle name, last name.

in addition, they wrote that "we found that you connecting utilities under a different name [name here]".

how (legally) would USCIS know, without running a SSN full background check on the petitioner's name, that my wife had a bill run under her daughter's name??

And they would be correct. The middle name is another name used, so if she only told USCIS her first and last name and never provided her middle name, she would not be telling the truth if she claimed to have never used any other names. The middle name is a very important aspect of identifying a person, and should be given on immigration forms when requested.

They know the address where she lived, so they only have to contact the utility company to find out whose name was on the account for that address. Whether it is legal for them to get that information, or for the utility company to give it out, I don't know.

all immigration forms shows her full name: first name, middle, last, accordingly to submitted birth certificate. I dont see my wife's fault if being pulled over, the officer was lazy and did not put middle name on her ticket, or something like that.

I dont know anyone who fills out every single field on eveyr form, going to macys, grocery, dentist, publix, etc.
 
Do you have a lawyer yet? USCIS has already made up their minds to deny your case and is doing an extreme witch hunt to find reasons to deny. You need to sort this out in court.

I wish I could know. I dont believe in any special protocol that exists to do so, other than subpoena.

Other way, everyone can call as "USCIS" and inquiry, that wouldnt be cool.

The USCIS uses Choicepoint to conduct background investigation. They do not call utilities.
 
I think its silly to consider a firstname+lastname as different name than firstname+middlename+lastname. I have never used my middle name for my utilities. I have used only middle initial in drivers license and some immigration forms (dont remember). Yet at N400 interview, officer noted that since my original country passport has middle name, he said we should include fully into the oath / citizenship cert. I agreed and thats end of it.

I think its extreme that they would go so far to pull this.
 
if anyone traced my thread regarding my notice of denial that they think my wife married somebody else 12 yrs earlier, we just got some results from certified handwriting analyst. conclusion: it wasn't her.

now just analyst must write a 50-pages report to keep onsite, in case USCIS want it.
I am dying to hear the reason they are denying me. Probably the will say something like even if it was not your wife, we thought it is, so it still looks like she has a bad morals and we have to deny you, or something of similar stupidity.
