I am currently an F1 student in NY in my last year of school and I have been going out with my boyfriend for almost 2years now. However he has been married to this other lady about 5 years now as a means for her to get her GC. They are in the process of divorcing and we are plannin to get married in the next year after the divorce is final. He also had helped his mother fill out that undertaking of responsibility for two of his siblings who reside in overseas and I was wondering if any of this will affect my chances of gettin a GC after we are married.

This will not help you, if the gov't is aware of it. It's literally immigration fraud. I am not sure how they treat multiple marriages, but even if they don't know the reason for his prior marriage, they will look a little more dimly at his next app, I would guess. Not the least reason would be that he had a girlfriend while "married" to this other person for immigration purposes. That being said, not sure how it affects your chances as it depends on how much the gov't is aware of all this, or cares to investigate it. This kind of thing annoys the hell out of those of us in real marriages, by the way.

Be careful. If you marry him, then you can't say you have been dating him for two years, because he's still married.

You will have to answer lots of tough questions. His application will be thoroughly reviewed.

I also think he has to wait a couple of years to petition another person. I think theres is a five year wait (but I'm not sure.)

You'd have to lie to immigration about how long you'd been together, when and how you met which they ALWAYS ask and he'd have to lie about his marriage etc. I'd say that's a problem.
