In need of some clarification and info...

hello all,

my husband and i are currently working on my green card papers, but we've had very little help from anyone actually involved in the immigration services, and, when i try to call their office, i can never get through to anyone:(

i randomly came across this site just today, so i'm hoping that i can get at least some help in correcting anything i may have messed up on, and some info on things that felt a little unclear.

also, for the record, my husbands petition and my own papers are all being done at the same time.

1) one statement on my husbands petition asks for my arrival/departure record. however, i'm from canada, and i've never been given anything like that when coming to the states for a visit, so i have nothing to show them:| what can i do about this? should i just not include it, or do i need to add something regardless?


2) what do they mean when they ask for the date and place of present marriage?

3) any question that i have no answer for, should i leave it blank or always write "none" or "n/a" ?

4) when it asks for a family name, under the relative section, do they want my married name, or maiden name?

5) i'm going to assume i already know the answer to this one, but for the areas where it asks for any info on husband/children of relative and other info, if there's nothing to add there, leave blank or add "none"?

i know this post is pretty long, but i'm almost done:)

as for my I-485 form, i just have a couple things that my husband and i both got a little confused on:S

1) when it says "Address: In Care Of" but then ask for the "Street Number and Name" what do they want written in the address: in care of area? i've never seen a form that asks for something like that.

2) i'm having a lot of trouble figuring out how i'm supposed to answer the "Eligibility" section. i don't feel like i come under any of the answers they have provided:

a. petition filed on or before January 14, 1998
b. petition filed on or after January 15, 1998, and on or before April 30,
2001
c. application for a labor certification filed on or before January 14, 1998
d. application for a labor certification filed on or after January 15, 1998,
and on or before April 30, 2001

if none of these seem to apply to you, how are you supposed to answer?

last, for form I-485, when it asks why you're applying for adjustment to permanent resident status, the first answer (an immigrant petition giving me an immediately available immigrant visa number has been approved) seems like it would fit me better, but, like i said at the beginning of this post, my husband and i are filing these all together, so i don't have a number yet:|

how am i to answer that section when my husbands petition hasn't been sent in yet?

that's all for those question. although i do have a couple other questions that no one else has answered for me.

first, i don't have an alien registration number. some people said that, if you're already married to a US citizen, you don't need one. however, others have said that i should have one anyway. who was telling me the truth?

second, form I-864EZ asks for proof that my husband will be able to support me. W-2s, paystubs and what not. my husband doesn't get paystubs though. the army pays him through direct deposit. will that be a problem, or will it be alright as long as he has other papers to send in?

i sincerely apologize for the fact that this topic is so long, but we really need help and we can't seem to get any straight answers from anyone who works in this business.

Who is the sponsor? Your husband? Or is somebody else sponsoring both your husband and yourself for a green card? It's not clear if just one or both of you are being sponsored, as you mentioned filing the papers "together".

Are you inside the US? If yes, how long ago did you enter the US, and are you planning to do adjustment of status in the US, or interview at the consulate in Canada? If you're inside the US and entered less than 90 days ago, you could have problems if you plan to file the I-485 (I'll explain letter if you tell me that is the case).

At this point you won't have an alien registration number. You would have one only if you went through certain immigration processes in the past, which you would not have done if all you did was visit for short trips using your Canadian passport. So leave it as N/A.

I don't see those choices on the I-130 or I-485. What other form are you looking at?

If your husband is the sponsor and he is a US citizen, (a) is the right choice. It's not about whether you have a visa number, it's whether one would be immediately available to you.

thanks for replying. sorry for not being more clear.

my husband is sponsoring me, and i entered the US 3 years ago. we would have done this a while ago, but, like i said, we've been getting the run around from others we've talked to.

the part where i asked for help dealing with the "Eligibility" is in Part B, page 1 of form I-485

also, one other thing, Part C, page 1 of I-485. do i HAVE to choose any of these?:|
 
Oh wait....I see what you've done. Youve got the wrong form.
The form youre looking at is Supplement A to Form I-485. This is not the form you need. Use the link in my previous post to download the correct one.

1) You don't have one then you don't don't need one
2) that's already in plain simple english..date and place of your present marriage.
example: married in Los Angeles, date is april 1, 2009.
3) don't leave any blank answers, always use N/A or NONE
4) If you have changed your last name after marriage, use your new last name becuase that's your legal name otherwise, just your current legal last name.
5) again..don't leave anything blank. this one should be NONE if you have no childrens.

You don't have an alien registration #. You'll get one when you become a permanent resident.

For I-864 -- Just W2 and copies of your husband's income tax returns. You can also make copies of his most recent 6 month bank statements showing direct deposits made from the US army.
 
so... you're telling me that the form i have been trying to fill out is the wrong bloody one? well, then, no offence to them, but the immigrations officers on base suck!>< this stuff is frustrating enough as it is.
