I had my N-400 interview last week JAN 09, passed the English and US history tests, but i was given N14 to mail some documents such as proof of income, rent, bank, credit card, loan since feb 2002, when i became the LPR(JUN 2002) and the list of all trips to present date with all the passports.

I have almost all of the above documents, IRS TRANSCRIPTS FOR LAST 10 YEARS, loan of car and auto insurance, bank and credit card statments, driving record, credit reoport, stock investment etc. I had the lease in my name in 2007 but most of the time i was a roommate all past years. The persons i stayed with, i can get a notarized letter from them that i rented the room for such period. I have also employement letter from my company.

Actually , due to sickness of my father and i being only male member available there, I stayed outside USA total of apprx 22 months(6 months, 11 months 29 days and 4 months) in different period of time in the first 5 years of LPR statutory period and had 2 addtitional trips after five years period, the one was for 2 months trip just after applying of N-400(25 MAR 07) i left on 27 mar on the death of my father(have death certificate) and second was i left 20th JAN08 and returned in 10 months as i went to marry and i had to stay with my wife there due to unexpected circumstances because there was no one available in my and her family to stay with her in my absence.

i never terminated my employment here in the US and i did not work in my country nor i purchased any property there. I did not close any accounts and i was in full access to my abode here in the usa, such as maintaining bank accounts, credit cards, payed rent, filed all taxes. Whenever i returned to usa i resumed my work in the same company. Now i have a little daughter born in Dec in my country of origin. I also told the CIS OFFICER that i want to bring them to US as i am settelled here for last 13 years. The officer showed concerns about the medical condition of my newborn because my newborn baby has been infected.

I just want to know where i stand now?

what documents i should send them as i have lived and settelled here for last 13 years and all of my trips to my country occured due to the circumstances beyond my control. As i never went to my country of origin with intention of lengthy stay but the circumstances changed there which compelled me to stay longer.

You have a lot of extended absences and therefore there is a good chance that your application might be rejected.

Are you being asked for the proof of INCOME (as you said) or proof of employment along with other stuffs you have mentioned?

I am sorry you are going through this,, all you can do is mail what they asked for and hope you are one of the lucky ones who gets citizenship even though you broke continous residence rules.

On this issue I have read many-- many-- posts because I was denied citizenship a while back due to this exact same issue and the post are divided some people are TRULY lucky/Blessed and they get citizenship others like me get denied.

By the way what is your newborn baby infected with? (prayers to you and your family)

I wish you the best of luck

n400 interview done but docs are required

Yes they asked for proof of income, for that i have IRS transcripts for past 10 years.

I want to know that i dont fall in the category of 4 years 1 day Rule
of REDUCTION IN WAITING, because in all my trips i did not stay more than 1 year.

can some one please assist me with appropriate advise or i will appreciate it.

thanks

I am gathering all the documents which were asked by the CIS OFFICER along with the Notarized letter from the persons i rented the room and i have also lease in my name for full year of 2007. I have the insurance proof and letter by GEICO that i had the car leased from 2005-07 and the car loan from
1999-03. I have got the EMPLOYEMENT LETTER with IRS TRANSCRIPTS for last 6 years as they want it since 2002.

I have stock investment papers for year 2002-05 and my account is still active. The truth is that i always went to country of my origin for few months but unexpected circumstances occured beyond my control, but i did not abondon my residence here, continuosly working here in the USA and never got a job outside of USA for last 13 years, maintained bank accounts, filed all the TAXES for last 13 years, renewd car registrations therefore USA has actually been my abode and permanant residence.i have possessed nothing in my country of origin. I will fight all the way for my right even i have to go to court because all my investments of time and energy for 13 years was done right here in the USA.

One thing i want to know that physically i was present in the USA for 37 months in the 5 years since i got my GC, then i should be fine as i fulfilled the
requirement of 30 months of physical presense and residence.

if they deny my application, then when could i apply again?

What is your DO ?
It seems like the IO has asked you for the docs to validate whether you fulfill residency reqs. The fact that he did not reject your application during the interview is a good sign. Just submit all the docs and for the rent if you have any checks showing payments to your room-mates that would help.

the checks i wrote to my room-mates were not many because i used to pay them cash most of the time. The other thing is that when i moving from Michigan to Florida in 2005 , i lost many of the documents in moving transition, but i am getting all the bank statements from MICHIGAN local bank
and also i have got the car loand and insurance proof from florida in previous
years from 1999-03 ...

there is another situation has arised that my newborn baby girl's arm has been infected due to Doctor's negligence and if i dont get my citizenship i will not be able to bring them here and then i hav to go again and stay with my wife and take care of my newborn....

but i never had any intention to settle there in my country of origin and i never terminated employement here, did not get any job there back...

i will have to fight for my right, no matter i have to go to any court...because
it will be disaster that i stay here and my wife and newborn alone there as
there is no one available in my family to be with them.

can some one please guide me how can i win this battle or i have to get
a lawyer....

thanks for everyone here and this is a great site which is helping lot of people
like me. i appreciate all of them who is contributing to this site
