i130 upgrade NVC OR VERMONT SERVICE CENTER

Hi folks I had apllied for my spouse i130 peteion in 2005 and was approaved in 2006 (at that time i was a permenet residence) and i was in queu for a visa no.I had received an approvael notice stating that the peteion is appraoved but visa no is not available and my peteion will be remain with the same office till the visa no is not available(vsc). Today i have bacome the USC and i called at uscis 1800 no and they told me i need to call at nvc or fax my usc certificate to nvc for upgrading the i130 petion and i did so but vsc customer service rep told me they dont have my record and i have to call ins then i call to uscis again they told me the same thing that call at vsc. This is a big confusion for me how can i upgrade the peteion which is still with vermont service center do i have to reapply or do i need to file i129 i dont know wot to do my spouse is in usa.

Hello Faith4u,

Since your case is approved in Vermont service center in 2006, they have transferred your case file to NVC. you need to contact NVC not the VSC to upgrade I130 petition.

Please make a copy of your Naturalization Certificate. Send the copy - NOT the original - to the NVC with a letter containing the beneficiary name and case number of the petition you want to upgrade.

Same case

Upgrading the case in the NVC is not that easy, when they say they have no record of your case. I am in the same boat and they said that they can't upgrade something they never received. It looks like my petition was never sent to NVC or got lost en route. Please see the link to the thread below:
