Hey, I have the following questions:

1. I submitted my I140 several months ago electronically and was sent to TSC although I live in CA. Now I140 is still pending and my case is EB1 and I want to submit 485. Which center should I submit 485 to? TSC or NSC? I asked several lawyers and got different answers. I wonder if any of you have similar experience and can kindly share with me or your opinion?

2. In terms of 485 processing, is there a big difference between TSC and NSC? Is it true that TSC processes it faster and might approve both 140 and 485 at the same time?

Thank you so much for your help and time

Now, irrespective of your geographical location, you need to file I-485 at NSC only. If you send to TSC, they will return the application.

Sorry but that's flat wrong, that rule has been outdated for the past year. The most recent direct filing rules tell you to submit to either NSC or TSC based on your geographical location.

To the original poster: You ought to follow directions and send it to NSC as you now live in California. Having said that, they may accept it at TSC as well (based on other people's experience on this forum) since your I-140 is there. Also, if you send to NSC, there is a chance that one of your applications will be transferred to the location of the other (also based on experiences I've read on these forums). Basically its up to you. As far as processing times, I-140s seem to be faster at TSC, but I-485s not necessarily.

jk0274, Thank you so much for your information. I always can get very valuable information from this forum.

The reason that I want to file 485 is to keep my application valid in case some bad thing happened to my employment. I will submit 485 form to NSC based on the instruction.

However, what you said about they might transfer application to the other center because of pending application really scared me. I have EB1 pending in TSC for almost 4 months and am going to submit 485 soon. So can you share what examples you all have seen from this forum about applications transfer due to another application is pending at the other center? 485 transfer to TSC or my 140 transfer to NSC or maybe they won't transfer, which one has higher possibility based on past experience? If I submit 485 to TSC, what is the worst thing going to happen? getting nervous.

Again, thank you for your time and help.
