Help - Decision can not yet be made at interview - two A files

Hello All,

I attended the Naturalization Interview today June 10th at the Newark USCIS office. The officer went over application and asked a few questions.

And then, he went on to give the English, History and govt test. he asked me to write a simple sentence and then asked me about 6 questions, all of which were from the 96 questions on the USCIS web site.

After the interview, the officer handed me the N-652 form, which has the following boxes checked:

1. You have passed the tests of English and U.S History and Government.


And, the officer also checked the line which says:

B) A decision cannot yet be made about your application.

he noticed that I have a second A file. He will request he case file so that they can consolidate both them into one file. he also said, this is not out of the normal and they should receive the file in a couple of weeks after which they will mail me the decision letter.

I have never B1, L1 and H1 visa, I am on USA right from first day with family based green card and applied for N-400 after 5 years.

How is this possible, I thought everyone is supposed to have only one A file? Has anyone else heard of such an occurance? And, would anyone know potentially how long I would have to wait to hear from the USCIS?

04/24/08: Rec'd interview letter
06/10/08: interview done - decision can not be made at this time

Did you apply for EAD while waiting for your GC? Maybe USCIS gave you a different A# for your EAD than your actual GC.

I have not applied for EAD during my GC wait for one month.

I have no clue why I have two A files. How long it will take to clear this issue?
 
Well technically they should wrap it up within 120 days otherwise you are eligible for 8 USC 1447(b) to file a suit in the District Court. My case is the almost the same as yours as they couldn't make the decision in the IV and I have been counting each day to complete 120 days and file the suit....

Please describe how you came to USA and how you got your green card. It would help us to understand why IO said you have a second file. You said it is family based green card. Were you saying that you were in usa and you were sponsored by your relative or your spouse? If so, it seems possible you have a second A-file on other form like I-130.

Probably your name is common so IO might have looked at other person's same name.

I asked IO regarding my second A files, he show me the number and also show me matched with my parent name and my name. I remember only last 3 digits of second A number. my file was processed at consulate office before I entered USA.

Is it possible that, due to the fact that your GC was processed at a US consulate abroad, you ended up with two A numbers? Does anyone else who underwent consular processing have experience with this?

I went thru consular processing for my GC process back home. I was never told that I had 2 A files in my record, but keep in mind there was still confusion with my case. I was asked to appear for the interview on 2 different occasions and both times my DO could not interview me as they didn't have my file. I was sent home.
 
Ahhhh.. It may be possible to create two A numbers. One was that consulate created A number. Another was that your gc's A number that was created by Service Center. That's my guess.

I had two A's file numbers when I had my green card interview long time ago. They consolidated two A's numbers into one A number (new one). It took 3 months to consolidate. First A file number was optional pratical training EAD's A number. Second A file number was EAD's A number. so they had to consolidate two A numbers into one A number.

Don't worry. it will take time to consolidate. You have 120 days. If you don't hear from them past 120 days, set up the infopass appointment or file something like lawsuit or contact senator/house of representative.

Yeah, your case sounds a little different - like the file was never sent from the service center to the DO (I have heard that this happens on occasion). I hope that not every case that went through consular processing has an issue with naturalization. That would be a looooooot of messed up cases though since so many people have their GCs processed at consulates. I guess the only way to know for sure is to show up for your interview.

I also went through the process via consulate in Germany and when I went through my N-400 Process there was never any mention of 2 A-Files. Sorry !
 
Mine was for No reason

I had same situation with No reason did not mention any thing about two A files are any thing like that but within 45 days of my interview i did recieve my Oath letter and my Oath will be next week.

I came on L-1 and then switched to H-1. I had 2 A files. So 2 A files can have multiple origins.

My IO told me that second A file is at the National Archives and they have requested it. It should get to them in few days. I received oath letter about 5-6 weeks after initial oath. You should be fine.
 
I am in the same boat, waiting for Oath Letter

Cleared Interview on 1/22/08 in Newark. But case is pending receipt and review of second A# file. I had done 485/EAD and then moved to Consular processing for GC. This created two A#'s.


Went for infopass on 5/23/2008. Was told that the second A file was already received at the office in Jan'08 itself, but has not been reviewed by the IO.
I have already crossed the 120 day limit, still nothing moved.....

Wait continues.....
 
2nd Infopass

Went for infopass on 7/7/2008. Second A file has been recieved and is in the review process and should get a Oath Letter in the next 2-3 months since the summer days are all booked.
The Officer at the counter showed me the latest status of the case, the print-out showed that it is with one of the IO. She took my name & address on a form and filed it to be sent to the IO holding the case, requesting for an oath.

Unless they schedule my oath before september'08, my fingerprint will expire...

Wait continues....
