Error in the application - need to update at interview - effects of that

To start with, here is some background information.

I had my lawyer prepare my application. I have had a assault charge on me with outcome of Nolle Prosequi. I have all the paperwork from the court about this.

So in the N-400 application on pg 8, questions 16 & 17 should have been checked yes, but only Q16 is checked yes and Q17 is checked no. Q18 has been checked no as expected.

Stupid me I didnt really check this part when it was filed. But recently when I was going through my application and asked the attorney about this. She said that was a error and will send me the updated application with an addendum immediately and she asked me to take the updated application with me for the interview.

While I am waiting on that I wanted to ask the forum this question on how will the IO react to this mistake which was an honest one? Will my application be rejected and will I have start over with my application?

I wasnt planning on my attorney accompany me for the interview because everything look straightforward and I had all the documentation prepared for the interview. Should I have my attorney accompany me because of this mistake on the application? I am really worried about the whole thing now.

What are peoples experiences in similar situation ? Thanks a lot in advance.

Do what your lawyer said and you should be alrite... you are innocent as far as that case is concerned. They might ask you about this as they will have records about your case... they will understand the honest mistake. Just curious when did that episode happen?

Thanks for the reply. Yes you are right about the innocence part, I have not been convicted and have no other record about me. So it should be fairly simple, but I am just a little worried about this mistake on the application.

How does an IO usually react to a mistake in N-400?

The assault charge happened in July 2004.

As what I have read in this site... it is not a big deal when u tell them about it in the interview and go there with a new form.
 
I just wanted to update. My lawyer sent me an addendum and the updated pg8 to take along with me. I have to hand it over to the IO at the interview. I hope all goes well.

It might have been a good idea for you to wait a total of 5 years from the date of resolution of this charge before you applied. But then, it is too late now, and you might be OK with all the documentation as the lawyer suggested.
