I need an advice for my recent situation I am working for company A and A filed LCA, I-140 and I-485 for me. LCA approved in June 2007 and I-140 approved on Feb 22, 2008. Company A acquired by Company B on Feb 20, 2008 and 180 days for my i-485 completed on Feb 25, 2008. I am still with A but B offer me the same job. I have not signed the paper work yet that makes me feel that I am still with A as my pay check coming from A. In this situation what should I do as B seems very cooperative and willing to do anything for me. I have contacted my attorney and she suggest me to take the job and use AC21 portability. In some forum I read in this situation someone has to file ammended I-140. Is it true?. I am affrid if I use AC21 on EAD and b/c of some technicality my 485 rejects then I have no option but to leave. I am on 4rh year of my H1-B. One of my paralegal friend suggest me just to sit tight and dont do anything untill or unless receive an RFE. Another thing when should I have to notify USCIS for about protability is there any dead line?

Please help !

Attorney is right. Use AC21 portability.
Either just file an H1 amendment Or file new H1. Both are OK .This has no bearing on your Pending I-485
