Infopass, FOIPA, Expedite

Hi Guys,

I had filed my N400 on Oct 3rd 2006. I am still waiting for my Interview Letter... been through couple of Infopass in Baltimore (same response file is in Vermont and case is going through background check and we cannot help u in baltimore as of now).... did several calls.. no luck!

I have now asked for FOIPA. On my way back from Infopass today, I called the 1800 customer service number... I have asked them to expedite my case on the grounds of medical and humantarian problems... the customer care told me that I should hear from someone in 5 days... Has anyone gone through such expereince.. please share... thanks

What medical condition(s) do you have to be qualified for expedite processing, if it's not a secret? And what is "humantarian problems"?
 
About to go Crazy.... Got married in feb 2007 thinking I can get my wife soon ... what I knew then.... it is still not done!!!! Don't know what to tell them if they call me so frustrated.

I called USCIS somewhere around the second week of January. My father was having a major back problem and was looking to have a back surgery. I told them about the situation that I might have to leave the country and not sure for how long. They rep said they sent a request to expedite the case and I should hear back in 5 business days. Also gave me a reference number for my request. Haven't heard back since. Called early Feb and asked them about the status. Got to speak to an IO who was very polite. She said that I am in queue for the interview and all I can do is wait.

Anyhow..From what I have experienced, they never got back at me in regards to my request although I was told I would definitely hear back in 5 days.
 
We talked about it yesterday.
I just think it is funny when they say they expedite your case. How can they expedite your case if it hasn't reached your local DO yet because the responses from expeditions and inquiry's come from your local DO and since your file seems to be still at the service center how is that possible.
I personally think they just told you one of their standard message again to get you off the phone.

Damn! Wish they had pool of people working only on older filings... Ladybug makes sense... they lied.

GhantaBro - just a suggestion, but since this is a "life or death" emergency then why don't you consider contacting your local congressional representative or US Senator? I know that these people cannot do very much for ordinary cases that are simply stuck in the queue, but many of them might be willing to intervene for you in an emergency situation.

If you go this route, try to document your emergency as best you can (in case they ask for proof) and also document all of your previous requests with the USCIS - that way, you can tell them that you have at least tried to contact the USCIS, but gotten nowhere. Regardless of what you decide to do, I hope everything works out for you.
 
my expedite case

I had asked the customer care to expedite my case on the basis of Medical - immense mental tension, Monetary Loss -- cannot apply for jobs with citizenship requirements and Can't meet my wife.

I received a letter from Baltimore DO sayin that:

We received your request to expedite the decision on your application. Your case is currently under review. You will receive a decision or notice of further action shortly...


I am sure all the above means CRAP, BS and it is just a print out sent to me with my name and address!!!!
 
Prewritten ... yea ... BS so I thought at the time too but on the other side I thought well at least they got my file back to the top of the pile because they had to take a look at it.

FOIA/FOIPA etc.

I guess you also need to request FBI Filed Offices for FOIA/FOIPA just to be sure. The FBI Headquarters only reports on what they have - the individual FO's have to be requested separately for info on any records.

I'm in a similar boat - applied for N400 in Dec 2006 (12/04) and still waiting. Had FP done in Jan 2007 and since then NOTHING! Done everything I could but to no avail. Will seriously consider WOM if I don't see any traction on my case by June (18 months would have elapsed by then). Thus far I have done multiple InfoPasses, letters to just about everyone, FOIAs etc. etc.

some info about WOM -

Priority Dates and Writ of Mandamus:
In employment based immigration cases, if your priority date is not current then the chances of success by filing writ of mandamus are negligible. To have a successful Writ of Mandamus, you need to have your priority date current. Otherwise the USCIS will respond to WoM by saying that the case is not actionable and a decision cannot be made until the case becomes current per visa bulletin.

- Your Case:
A writ of mandamus is best for clean cases (where there are no
criminal arrests, or more importantly, convictions) because a writ of
mandamus only compels the government to make a decision; it does not
say what the decision should be

- How long have you been waiting whether to pursue a writ of mandamus depends on how long you have
been waiting on your case (and for employment based cases, if your
priority date is current). Rule of thumb: waiting less than 1 year -
not advised unless continued wait would cause harm; 1 - 2 years -
should consider WOM; 2+ years - it's time to file

-Possibility of Class action because of the individual nature of a writ of mandamus (as noted in
the above 2 points), and because of the difficulty in getting a
national jurisdiction, WOM does not easily lend itself to a class
action; Joe Hohenstein(Orlow and Orlow) will follow up on this in more detail at the American
Immigration Lawyer's Association (AILA) convention later this month
and get back in touch with Jay or myself

- Citizenship cases if you are applying for citizenship, you have a stronger option than
writ of mandamus, called a peitition for declatory judgement, where
you can argue not just for a judgement but for an approval of your
case as well; in addition, when applying for citizenship, there is a
hard and fast rule vs. the rule of thumb for WOM -- with citizenship,
you should definately file after 120 days

- why WoM works when you file a WOM, it is embarassing for the government, and they
do not want have the courts examine their decision making process; in
many cases, if they get a letter from a law firm that they know will
file in federal court one month later, they will often process the
case; a successful WOM is settled before going to court

- Court appearances you do not have to appear personally in court when you file a writ
of mandamus 99.9% of the time. Joe said he is yet to see a case where the client had to go to court with lawyer and argue WoM case.

- typical cost: between $1,500 to $2,000, plus filing fees of about $400





What can be done collectively:
The issue with
name checks is not funding, but an institutional culture that believes
that our issues are unimportant and that should not be addressed
because it might impact the ability to find the "needle in the
haystack" threat to security. What is needed to combat this is to
debunk this argument, so our collective efforts might focus on working
with non-profits to study this issue in more detail, as well as
identify members of Congress who might help.
 
called the customer care and gave them the wrong number.. the forwarded the call to someone else (I think that IO)... she told me we cannot do anything about Name Check... I asked her any advice that she wants to give me that would help ... she goes I will give you the FBI webpage... I was like don't you think I know that... she was ahh... and then I asked her can I sue the immigration department... would that help... she goes not really .. .I said I think so. I took her name and said #$%^ U in my mind and hanged up the phone.... But one thing.... THEY HAVE HIRED LOTS OF PEOPLE ... lots of people to HANDLE the calls coz every calls are being answered in 2 rings...
