Worried about I 485 being denied.

Hi,
I am from a very under-represented country. I went to 4 year-college in the US and has been on OPT and H1-B since I graduated almost 7 years ago. I have lived in the US for over 12 years.

My company has filed for my H1 B to be renewed past its natural lifetime due to my pending EB 3 I-485 application at the Texas Service Center.

I have passed all stages very successfully so far. I have never had any problem getting my H1-B renewed or getting back into the US. Labor was approved back in April, and I-140, shortly after. EAD and AP were also pretty quick to arrive. I don't have any health issues nor do I have to worry about my criminal record.

However, since I got my FP notice, I realized that it could be any minute before my application was processed. (FP was done back in October 2007). So I started doing a lot of reading about other people's AOS getting denied. Now I have this fear that my I will get denied too. HR has reassured me that there is really no reason why I should be.

While I don't think I have been illegal in the US, I have been laid off twice. Both times I left the country and came back less than 2 weeks later to work for different companies with old H1B visas.

So my question is very simple. Has anyone in my situation had their 485 denied? If so, was it without receiving an intent to deny letter? If I get denied for the reason metioned above, could my lawyer do anything about it?

Looks like you worry too much. Just relax and stay with the flow. Your case should be fine.

i do worry too much. My world would come crumbling down if I had to leave the US after 12 years.. I almost feel like I am from here now.

Has anybody else been through the same experience as I have? Was your AOS denied or approved? Did you get a letter of intent to deny?

Don't be afraid of the future.
Your future holds opportunities and challenges for you, not menaces and dangers.

If you will get denied (which of course may happen but unlikely) your world will not crumble down.
Yes you would have to move. You will discover that there is life outside of U.S. And that life isn't all that bad.

Let's face it: the U.S. is entering a deep recession on par with 1929 crash. Wavering this crisis outside may be not a bad option.

Consider the benefits:
first, you wouldn't have to pay U.S. taxes
second, you will see the world
third, you may go visit your home country and find a better life there with your american experience.

True, I agree, and by the way..cool response.
It is just that I have gotten used to being here so much, that I feel like it would take forever for me to re-adapt. But you are absolutely right. Can't be the end of the world. Thanks Amerkanus.
