Hi there, I have quick question

I got my greencard in January 2004 and I am eligible to apply for citizenship in September 2008 (4 years and 9 month period) and now my concern is that my company is urging me to go to Denmark until June 2008 and i am not sure if during citizenship they accumulate all the absences from US or continuous stay of 6 months?

I have been outside US for : 2 weeks in 2004, 4 weeks in 2006 and 6 weeks this year 2007 - so in total of 3 months since I got my greencard.
If I go outside US now can i stay outside US for another 3 months or 6 continous months.

Any helpful advice will be appreciated.

Regards,
Harshveer

Even if it is business-related, I would recommend you DO NOT stay outside the USA for 6 months. 3-4 months for business reasons sounds reasonable, just make sure you get documentation from your employer indicating why you are being deployed to Denmark. You do not want to jeopardize your continuous residence which will in turn make you ineligible to apply in September. Also, while you are gone, make sure you maintain your US ties (i.e. house, car, bank statements, etc).

Hi, Thanks for your response. Yea, all my financial involvement will be here in US as usual - i mean salary taxes everything will be same and our company allow me to come back every month. but again when they consider me for citizenship are they going to accumulate all my previous monthly vacations with this business stay outside US. So i know if i can stay 3 months more or 6 months?

Sorry if I confused you.

Thanks

I don't see any reason not to go.
You should not be away at any time more than 6 months and you have to be in the US for at least 30 months during the 5 year period. Your previous travels do not count toward that six months limit.
Your stay will be less than 6 months, you have travelled very little previously - you shouldn't have any problems, especially if you have short-time contract, have US employer, pay US taxes, come back every month.

well i am confused now.. the responses i got so far is that they add all my stays outside US and if they dont then I can actually go to Denmark. I really need to give an answer to my human resource by Monday.
The client really wants me in Denmark but I can't accept to delay my citizenship since my fiance is in India :)

Let me try to understand - so even if go there 1st of february and come back every month- salary, taxes, mortgage and bank statements all are intact in US and eventually get back end of June. They wont accumulate all my prior vacations which would make my entire stay outside US around 8 months or so.

Would I still be eligible for applying in September 08?

Thanks please let me know

Harsh,

two things are important
a) any single period of stay outside country should not be more than 6 months and if so u need some INS Waiver
b) total periods of inside US should be more than 30 months

both the above conditions are being met by you hence you qualify.....That means that you can go to Denmark provided your stay abroad is less than 6 months.

Oh yea, Thats right.. the project ends in June 08 and they will allow me to come back every month. So I can go right and it wont impact anything right?

Can you please confirm again so I get back to my HR.

Thanks so much for the response.
