Canada landing and H1B visa renewal at Ottawa

Dear Help Providers,

We are in Chicago.
My brother has Ottawa, Canada Appointment for US Embassy passport stamp for H1 on 28th Jan 2008.
Currently, his H1 stamp in passport in over. But, his current employer's I-797 form shows visa is valid till July 2009.


I have several questions.

1. He has to land in Canada latest by 25th Jan 2008.
Is it possible, he can land in Canada and right away come back to USA with I-797 form and passport ?? Reason to get in Canada was only landing.

2. How to make US $131 draft for Visa Application Fee? It should be from Canadian bank (Scotia bank) only ?? Can I do this by keeping ourselves in USA? What is the procedure?

3. If as per point 1, if we can come back in USA back, w/o visitng US Embassy for stamp, can we get US $131 back ?

4. Any good location for accomodation in Ottawa? Motel etc. ?

5. How much time US Embassy, Ottawa takes to return the passport? If I visit on 28th Jan (monday), when can we get stamped passport back?

Note: He has no Advance Payrole kind of thing. He got EAD, but no I-140 approved.

Did your brother already took an appointment at the U.S. consulate? Otherwise he can use the automatic visa revalidation rule to return (within 30 days). Check with the consulate about refunding the visa application fees on cancelling the appointment.

You can cancel your appointment anytime and still save visa fee. I'd recommend to use Automatic Visa Revalidation and return within 30 days without stamping visa.

FYI - You have to pay the visa fee at Scotia bank and show the receipt at the consulate.
 
Well, if your appointment is cancelled, then you can not get refund of that $131. But, same draft can be used by yourself again or anybody else can use it.

Well, draft will be expired in 1 year from date of purchase.

Note: Youcan not purchase Scotia bank draft by keeping yourself in USA. You(or your friend) have to visit Canada based Scotia bank. Scotia bank is not opened in weekend. Poor Canadian banks(at least Scotia) are not opened in weekend. So, you have to waste your 1 week day.

Canadian USA Embassy should choose such banks, which are open in weekends too.
