I-765 Fee Question

Hi guys,

Do any of you know what is the filing fee for EAD - form I-765 for people that have filed their I-485 in the period between 7/30/2007 and 8/17/2007? The USCIS.gov site has ambiguous information on this. The instruction page for regular filing of I765 says there is no fee due for people that filed their I485 after 7/30/2007, yet the page for Electronic filing of I765 says that people filed their I-485 before 8/17/2007 are eligible for the old fees before the new fee change of 7/30/2007. So what is it? No fee or old fee?

Here is the text from the "Application for Employment Authorization":

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765.

Here is the text from the "Electronics filing for I-765 instructions":

Filings made Pursuant to Visa Bulletin No. 107: As previously announced, all forms I-765 and I-131 applications based on employment-based adjustment of status applications filed pursuant to Visa Bulletin No. 107 that are submitted on or before August 17, 2007 must be filed under the fee structure in place prior to July 30, 2007.

P.S. To clarify - I filed for I485 in august through the old fees.

If you paid the new fee of $1010 for your I-485, then you don't pay any fee for I765. If you paid the old fee of $395 regardless on when you filed I-485, then you have to "cough up" $340 for EAD. So in your case you have to pay $340.
