Check not sent with EAD..can i reapply now?

Hi,

I am in a peculiar situation. If anybody has gone through this situation and shed some light on it, it will be very much appreciated.

When dates were current in August, I filed for EAD for both myself and my wife along with the I-485 application. My EAD has been approved, but I never received the receipt for my wife's EAD. When I checked with the attorney, they mentioned that the check was not sent for my wife.

I did not get any rejection notice from USCIS either.

Now my question is:
1) Can I refile the EAD for my wife although my PD is no longer current? (I have a priority date of June, 2004)
2) Assuming yes, will the application for this EAD be processed based on the original date of filing ( which was mid-August)?

Appreciate your help in this regard.
 
I believe that USCIS doesn't entertain anything with out payment. they will deposit the money first and then they check the application.

You can re-file EAD any time but the new fee. you can do it in online as well.

Did your wife got her I-485 receipt? If I-485 was filed propelry for your wife she can apply EAD at any time.
