I-765 Important question

Hello all

We just got an update from USCIS online case status that my wife's employment card was sent to production. So i'm assuming that it was approved and completed. It was approved on the 10/24, but it says that it can take 30 days to get the darn card.

Now my question is, my wife's employer keeps asking for the updated card, since the current card expires in 9 days. They keep saying that they need the card otherwise they will terminate her employment.

What can she do to prove to them that it's approved and her ability to work was extended for another year?

If i go to the local INS office, will they give her a temp card, or am I just wasting my time?

How long does it take to get into my mailbox after production?

If the card has been ordered. That means it will take at least 2 weeks before she actually gets it in the mail. You can print out the online status for the EAD and bring the EAD receipt and show them to her employer... there's nothing else she can do and USCIS is not going to issue any temporary card.

Oh boy!!! Assuming it takes 2 weeks, it will be the day before it expires.

That's 2 weeks in the best case scenario. 4 weeks worst case.

Maybe she can take sick days or vacation time while the card has not arrived? :D

OP do as Mr. Praetorian stated, because that's the only thing you can do and he knows what he is talking about (especially when he loses the sarcasm).

Anyway I would just add that if you are lucky from my personal experience and from observations, you may get the card around 10 days from initial "card ordered" email.
 
In my case, it took 4 days from I-765 approval email to "card production ordered" email, and then another 5 days from then to receive my card.

I believe USCIS will only issue you a temporary card if it's been more than 90 days since you applied for I-485, which is not the case here. Also, I remember reading somewhere you have to be in physical possession of the card before you can use it as your basis to work, someone correct me if I'm wrong please (The EAD approval notice might state you can use it instead? I don't have mine on me.).

Can she convince the employer to give her an unpaid leave of absence for a couple of days if necessary? I'm not sure about vacation or sick leave because these are presumably paid leaves.
