Inquiry about Status Change from F-1 to I-485 pending?

My wife, is a graduate student at SDSU with F1 status.

I have applied for her green card (I-485) and we got the Employment Authorization cards.

We wish to change her residency status from F-1 to I-485 pending.

She has been in California for more than a year. Will she pay in-state or out-of-state tuition fee?

I would really appreciate your help in this regard.

Hi neighbor:

Contact SDSU International Office. It is not just a matter of immigration law, but also one of state law.
 
Contack even Registrars Office. International Student
Center points them. They decide about residency.
 
They probably won't count the time spent in F-1 status towards the one year of required residence in the state; it is likely to start from the filing of the I-485. But contact the university and/or read up their web site or catalog to find out.
 
It depends on the state you're in. One may be eligible for In-State tuition just for being a spouse of a USC that is a state's resident. I know that for a fact, I am F1 but now paying in-state tuition and I haven't even got my EAD yet. They said they needed proof of my Wife residency, my receipt of pending GC, and our marriage certificate. If I was you, I would contact an advisor who knows what he/she talking about at the registrat office of the college/univ you attending. Hope this helps,

i found out from the registrar office that she can change status anytime to non-resident based on I-485 receipt notice but she will have to wait one year to be considered for in-state tuition.
