Interview in Boston today- Petion approved!

Hello all,

thank you all for your help! My petition was approved :)
however Name Check is Pending :( I will address some other details as well


Our appt was at 8:30 at Government Center so we opted to take the car so that we can keep most of our office related (our bags, cell phones, PDA, Laptop) in the car. The parking is very expensive!! So take the Government Center T-stop if you don't have much of office stuff or not planning to go to one.

Now we reached there early by 7:30 we had entered the building (a huge building) and has the security check at the entrance. We emptied all our pockets and went through the screening.

We then went to our interview room which was bit of a walk (3-4 minutes in the building) however on the same floor.

At the entrance of the room we were asked for our immigration notice and then we were allowed to enter and report to the information desk. There we presented our immigration notice (didn't check Ids). After that it was a waiting game. Since we were in the room till 8:00 we simply had to wait for Interviewer to call out our name. When our turn came we were asked to come inside a different room and go to a specific room no.

There first we were made to stand and take the oath of truth (Nothing complex just asking us to be truthful )

He asked me to sit at a specific place since my wife was USC

He then asked for my wife's driver's license ONLY

He asked me to give
My passport,
SSN CARD
Driver's License
H1b related notice (which had my EAC# and card the same one that I used to go to my H1b interview in the past)

Upto this point he was formal and he started by asking me my wife's birthdate and asked my wife if that was correct. Then he asked my wife the same question and asked me for verification.

Following this he asked me when did I last enter the U.S ?

Tell me when did you first meet ?
When did you get married ?

Tell me the story of how you met ?

Show me your proof of marriage
We came him our entire set
Marriage Certificate, Lease, etc.. (he didn't seem to check anything) however he was interested in my marriage certificate.

he then asked for how many people were present and we showed him our album (we had PLENTY!!!!) so he was suprised and started laughing..this is when he made the conversation very light...

He was trying to make photocopies and we said we have them and just gave him the bunch and he was happy of course (this was because of one of the postings in the forums!! thanks in advance)

He asked me affiliations with organizations...which was also provided in my application and he verified that...

After this he simply asked all the 'No'...questions

Then he mentioned that I cannot give you the green card !!!!!

Our hearts froze at that time!!!!!! as we didn't see anything wrong
Then he started explaining that this is because Name check has still not cleared and that we will have to wait. So we proded further just to be clear. Upon which he clarified that the Petition is approved!!! but he cannot say

'when' the name check will be cleared. It can be from 2 weeks to ...several months :(

Important!!!
He also mentioned that since I was on H1b and had travelled outside the country several times...this will take more time!!!!!

Also, when I asked can we find out the status on this and he advised 'against' doing so. This is because he said that everytime you check your status your file gets pulled out!!!!
Further delaying your Name Check....

So at this point!!!! It is going to be a waiting game...and I can't travel outside the country this is a bit of a bummer because I was planning to visit my country in December and going to Canada in Sept.

Anyway...we both were so happy...that our petition was approved!!!!

All this took about 15 mintues :).
We were out on the road by 9 a.m.

So now I am waiting for Green Card in Mail!!

I hope your name-check clears soon and you will get your GC before you have to travel.

is there any reason why the immigration officer asked you not to travel? can you explain that?

The reason was not clearly explained by the Visa Officer. Initially he said it is fine to travel on H1b. However, he had an after thought and recommended against it.

My conclusion!!!! NOT THE OFFICERS!!!! from here on....

I believe there is no strict rule however, the problem might arise when you get your Name Check and Card is sent in mail.If you are out of the country then at entry there might be a chance that in their updated system it shows you have a GC however you are trying to enter on H1b.


Maybe this might be an issue.

This is my opinion. Unless the delay ends up in 5+ months..I think I am fine not traveling...

Congrulations for your successful interview.
You have mentioned in your earlier post that if you travel outside the country then that may delay your FBI Name check. Where did you get that?
We are in the same boat. AOS interview was approved and now waiting for Name Check. My hubby has made several trips outside the US for business and family reasons. Do you think that poses a dealy in getting FBI name check?

This is what the IO officer told me. I am not sure whether he was shooting in the dark. I guess if your husband is the beneficiary and has been able to travel back and forth it should be fine.

Was he traveling on H1b or on something else. He might also have filed a form (I forgot the name at this point) that allows one to travel. Many people have filed this and maybe they might be able to guide you better.

Don't travel sounds like a wise counsel, with the CBP agents acting crazy, who know what they might do to you....:rolleyes:

My husband has travelled when he was on F1 and then travelled many times(out of country) while on H1b.

This is what the IO officer told me. I am not sure whether he was shooting in the dark. I guess if your husband is the beneficiary and has been able to travel back and forth it should be fine.

Was he traveling on H1b or on something else. He might also have filed a form (I forgot the name at this point) that allows one to travel. Many people have filed this and maybe they might be able to guide you better.

I traveled quite extensively while on F1 and H1B and my name check cleared quickly. I'm not sure how much of a relation there really is here...

Have you heard ANYTHING from the USCIS since the interview? I waited for over a month and nothing happened. Then, I made an InfoPass and everything started moving. I guess they found my file under somebody's desk. :rolleyes:

Maybe you should do that, too?
