My wife and I went to our interview yesterday everything was going okay until the officer asked my wife when was the last time she entered the country. She told him it was in 1996. Then he proceeded to check on the computer to see the history of the visa that she used. According to his computer there are two additional entry, departures that occured in 1999.

My wife had her passport stolen two years prior to that, she filed a police report on the matter. So someone stole her passport and used it two years later. Entered the country and then left.

The officer told us he can not approve the case until we get him some evidence that. so we have to go back on september 17th and bring the evidence with us.

a) she was here during that period of time. Which would be easy, but being that she is here illegally she did not have a bank account or anything that is in her name. She didnt work because she was staying with her aunt taking care of her kids.

b) We have to get a copy of that police report, but i am not sure if they will have a copy since it was filed back in 1997. and my wife does not remember if she stated that her passport was stolen.

We don't know what to do, more than likely the case will be denied if we can't show enough evidence that she was here. What if this is the case? I know we would have to apply for a waiver, but does she still have to get an interview at the consulate in the country of origin?

Anybody been through anything similar. Please any comments would be great.

A copy of the police report will still be available. Contact the police station where you reported it.

You should find something that proves she was in the US at the time, whether it be a piece of mail, statement from a Doctor, Dentist or other professional.

Time is of the essence so act quickly.

you can show any kind of proof. Like if she has credit card through you. or, even e-mail , letters, any plane or, bus ticket, anything that has her printed name and date on it would be proof.

Some ideas... Did she have a cell phone in 1999? Even if it was prepaid, as long as it was under her name, the call history can be obtained from the carrier. I believe that could be used.
I know it is not that recent, but she should try to remember what was her routine around that time and figure out if there is anything that could be used.
I hope it helps.

Good luck!
