I am going to file NIW myself. Would like to know my success chance.

My qualifications:

1) Ph.D. from average US university
2) Worked in the US industry (top 4 company in its field) 1 year
3) Worked in the US academia for average university as a Research Scholar (1 year)
4) Currently work in Europe (top 2 company in its field)
5) 24 Conference + 8 Journal papers (first name on all)
6) Refereed 9 times in top Symposia/Journals
7) Have 11 Citations (excluding self)
8) Contributed (informally) to two thesis in the US
9) Field is Electrical Engineering and Computer Science

If anyone is familiar with the matter or have an approved case, please let me know how likely it is to get my NIW approved.

The free evaluation some online sites offer has given conflicting results with large variance. Hopefully, I will find my reply here.

Thanks.

Regards.

For EB2/NIW to qualify- it is not the number of papers (you don't even need a Ph.D),

You have to qualify in one of either: Exceptional ability or Advanced degree (do not need to qualify both)

*the most important thing*: how well you can establish the following important criteria:

Your *proved contribution* in the area you intend to work
1. Should have intrinsic merit
2. Should be of national scope
3. National interest would be affected if gone through labor

Couple of additional things to remember

1 .Never mention labor shortage is the reason for requesting NIW

2. Remember to prove this:
"that the alien will serve the national interest to a substantially greater degree than would an available U.S. worker having the same minimum qualifications."

for this, you may want to prove:

your documented achievement are more significant/noteworthy by comparison to others in the field and are above that normally attained by somebody at your current level.

A must read is here (p. 57-61)

Good luck,

By item 3; do you mean that I should have not gone through a labor based GC filing in the past by a US employer?

Good question. Since NIW is not tied to a specific job- I think you should establish that the field (your future job(s)) in which you are going to work will be severely affected if had gone through labor. Again, I am not an expert- my opinion is based on what I read over the forums.

Thanks for your reply. I was wrong.

As with Item 3, one must show that it would be contrary to the national interest if she/he is required to go through labor certification.

It makes sense to have such a check. The question is what kind of evidence one can supply to support this?
