To or Not to use AC21

Hi

I have an approved EB1-OR I-140 petition sponsored by my university and was approved March 2006. My 485 was filed in september 2006 and have crossed 180 day requirement.

Now I got a job offer from an industry with a different title but same duties. Now I wish to invoke AC21 and switch job. Is there a problem moving from academic job to industry job?

My attorney declined to answer as he is also representing the present employer. I laso consulted local attorney, he says AC21 is for cases with backlogs /retrogression and he says the case will get complicated if I move.

But, I see in this forum several people had succeeded with AC21 and moved.
Can I move or not!! Any experienced folks please resond!!

I would say - speak to Murthy or Rajeev Khanna...these law firms are very knowledgable...

It doesn't matter whether you do the same job for a non-profit company (like a university) or a profit-making company....a Job is a Job....As long as the job duties and job titles are same...AC21 laws make your I-140 portable...

I would say - discuss this with the new employer's company lawyer....make them pick the tap on this.....if possible...

My lawyer is Mr. Khanna and now I have taken appointment with Murthy's firm this week. Let me see what is their advise. Thank you for sending me the links to the documents.

I need some advise. situation is this I got approvd LC and I-140 in last Nov then I changed the employer now i filed mine 485 on 4th Aug. my 140 is still invoke. what would be happends now and what i have to do. would appreciate
