I 197 Problem - URGENT !!!

Hi

I admit that I'm a fool.

I worked with company A (2000-2001) using my OPT then got offer from company B who filed for my H1B. Again, I'm a fool that I never bother to
ask company B about H1B nor they informed me about the process.
I worked with company B from 12/2001 - 11/2003. Since my employment in company B, I never had any problem whatsoever.

I left US in 2004. Now, in 2007 I got job offer from a non profit company and willing to sponsor my H1 but I do not have anything (I797) with me now.
To process this my lawyer needs the copy of my I797.

My questions are:
- can I still file the petition without presenting the I797
- how can I obtain information whether company B was filed my H1 (in 2001)
- what are the odds of getting approved

The company B must have given you I-94 which comes with I-797. When you left US did you have that I-94. If you didn't have that ask the company B about that. If thsy didn't apply for H1 then you are in big trouble. because it means you were staying and working illiegaly in US. Probably big companies don't take this kind of risk. So talk to company B to get your I-797.
