Intent to deny ?

Hi ,

There was LUD on i-485 yesterday 07/18 and today 07/19. I called to TSC today, IO ask me by case number and name and address. She told me that they have sent me "intent to deny" notice. She did not give me any more information.

When i check online message its still same "This case is now pending at the office to which it was transferred".

There are two possibilities for "intent to deny".

1. My Company got acquired by another company after I received approval for my I-140 in (in JAN 2006). I applied 2nd EAD and advance parole in 2006 Sept and i received approval. now I have applied for 3rd EAD and advance parole. My lawyer did not submit any documents to USCIS about company acquisition. He suggested to wait till RFE for employment verification.

2. I have not submitted non availability certificate for my birth record. BUT i have submitted one affidavit from my mother and one from our family friend and also school leaving ertificate.

I don't know what could be the reason, please let me know your commets.

I am sorry to hear that, have you seen any LUD's prior to 07/18 and 07/19.
 
LUD after 1st FP in 02/2006 , 06/2006 ( don't know why )03/27/2007 ( for transfer from VSC to TSC ) and now 07/18/2007 amd 07/19/2007

I have seen LUD's on my 485 on these dates, I don't know why it happened. I just received the FP's for 485 couples days back, now I am scared about the LUD's on my case also....

I was in the simillar situation.

My Labour was filed by Company 'A', in July 2003. My Labour was cleared within 3 months. My I-140 was filed in Nov 2003. On Jan 1st 2004 my company was acquired by Company 'B'. My attorney initially said that I need to refile the I-140. But few days after that he said that refiling is not required. So when he filed my I-485 in Feb 2004, he added the records relating to the acquisation.

Also, my spouse did not have a birth certificate, so we did get a affidavit from the parents. So I don't think this is an issue.

I also changed my Employer and did not send AC21 documents.

I did receive a RFE asking for my Employment Letter, W2, Tax returns etc. And my spouse's Passport, All H1 documents, Pay-stubs.
We responded to the RFE.

Then, I received a NOID for missing the FP, We responded to the NOID within a week and was received by them on the 28th June.

On Jul 19th our case was approved:)

So please do not worry, act immediately and reply the NOID, and that reply will trigger your approval.

LUD and message change "REF Received" on 6/12/07
LUD with no message change on 6/13/07
LUD with no message change on 6/20/07
I485 NOID RD 6/25/07, ND 6/19/07 for missing FP, Responded to NOID on 6/26/07
FP2 reissued and FP2 was given on 7/17/2007
LUD on 7/18/2007 (Spoke to TSC IO and she said the no visa has been assigned to my case and asked me to wait untill October)
I485 - AD 7/19/07

Don;t worry,
Get the NOID. It ill have the reason.
Respond to that and that should trigger your approval.
What is good is that you have visa number assigned and your case is being processed by an officer

Thank you for your comments and sharing your case. I hope its related to acquisition and not birth certificate.

I spoke with my lawyer and he said that there is no way we can know anything before we receive RFE in hand.

I will keep posted.

I think it most likely a NOID for missing FP, and if it is indeed for missing FP then it is really easy to fix it.
 
arcane , yes FB is also one of the possibility but there was no LUD after 03/25-27 and also that lud was for transfer.

my LUD's

multiple in 02/2005 ( FP ) , 06/2006 ( not sure why ) 03/2007 ( transfer ) , 07/2007 ( NIOD )

IO told me that NIOD is sent on 19, I hope I receive it on monday.

I talked to TSC IO and she told me the exact same thing. It looks like an intent to deny was mailed to my attorney on 07/21. Did you actually receive the intent to deny yet? Please let me know

I have not yet received the notice. My lawyer is keeping eye on mails. Also i have sent an email to my old lawyer to check his mails.

My lawyer has received the NOID. Issue date on letter is 07/18/07. it took 5 days to receive the NOID from uscis.

NOID is for TB skin test.

In 2005 while submitting my application , I asked doctor to do the x-ray directy and skip the skin test to save the time. I submitted my i-485 before 2 days of cut off date.

My lawyer sent me scan copy of NOID, i completed the skin test today, going friday to get the result , if positive , i have to go for x-ray again.

I think i will able reply to NOID with new exam results by 31st.
