i-485 – My medical report is good but my husband’s has a problem

I am about to file for my i-485 my medical report is good but my husband's medical report has a problem. He needs to take treatment for One month and he has just started treatment. I don't what to wait till the treatment is over.

Can I file for i-485 without my husband's medical? By the time the RFE comes his treatment would have been over and we could produce good medical report.

Or Can we take a letter from the doctor treating my husband, stating that the treatment has been started. In this case will the civil surgeon give the sealed medical report which would include the letter from my husband's doctor.

Or any suggestions please.

If an I-485 application is filed without the medical report (I-693), the application will be immediately rejected since the initial evidence is missing. In the past, USCIS used to send RFEs for such issues, but the new policy requires the application be submitted with all required (initial evidence) documents.

Are u sure about this? cause the latest rules on USCIS web site seem to indicate differently....

If given a chance, it is better to apply than wait.... Waiting is something USCIS makes you do and you don't want to choose extra wait :-)

I remember reading it in latest USCIS FAQ, that 485s can be applied without medicals. Please consult without your lawyer before doing this. If I were you I would apply without medicals.
