No 2nd FP till now. Any reasons? Gurus suggestions needed.

So, this means, they grabbed a bunch of cases that can be approved till OCT07 and have reserved all the visas # available for this cases. This way, if yr case is not under review or with an adjudicator officer by today, your chance to get approval till OCT is ZERO.

I am in the same boat. I did my last FP (code 3) in Mar-2006. I did not receive another FP request this year. I have been calling TSC for the past one month. In the beginning all IO's were telling me that the case is with an officer. When I called last Friday, the IO said that my FP has expired and she is going to request one and I should wait 2-3 months.

I have noticed the trend on recent approvals that these people completed the FP in the recent months. I was on an impression that if the FP has expired, they will go ahead and approve the case, but the card will be ordered once the FP is completed. However, I have not seen a single case approved this way. Therefore, it looks my approval will not come until I complete my third FP. Very depressing to see so many approvals with PD much later than my case.

FPs are a part of security checks - USCIS cannot and will not approve without FBI saying that your FPs are fine. What USCIS does *not* wait for is your biometrics. So, even if your photo+signature is not in USCIS databases, your case can be approved as long as your 10-prints are cleared by FBI.

You should push to get the FP notice soon. You can even try to go to your local ASC and speak with an officer there and explain that you were told your FPs have expired, but that it might take months for TSC to send you a new FP notice, and ask if the officer would please let you provide your FPs right away.

Thanks for the explanation. I was mixing up the bio with FP (secutrity check) and what you are saying make sense. I completed the last FP over 17 months ago. Have you seen any approval here with expired FP, but within 3-4 months after expiration, like my case? If I have to give the new sets of FP, my fear is the approval will not happen before OCt-07 and with new visa quota I don't know how many more years it will take for my case to be approved. I was really hoping for my case approval before Oct-07 from the tagged visa number from this yeat quota.

I may have seen a total of *one* such case, but I may be mistaken about that one. USCIS standard policy is that FPs are valid for only 15 months, so it is *very* unlikely that they will approve a case with expired FPs. In fact (and I may be wrong about this, since I don't remember the details well), the case doesn't even get to an adjudicating officer unless the FPs are valid.

What was your 7/24/07 LUD for?

2 months ago, I was kind of in a similar position as you are in now (hoping to get approved with expired FPs), but then I realized it's better to have updated FPs than to hope for something that is very very unlikely. If nothing else, by having updated FPs, my case would be ready for approval in October.

So I'd suggest that you try to get your FPs done again ASAP. Your PD+RD is pretty old, so there is a good chance your file is tagged with a visa. All you have to do then (to make it easier for USCIS to look at your case) is provide them with updated FP results.

I am not sure why the LUD on my 485 changed to 7/24/07. I think either because my file moved to an officer or it was tagged with a visa number. In either case, I should have seen something by now, approval or a FP notice. Ever since the LUD changed, I have been calling the TSC reguarly and below is the log with any useful info I received from IO's.

7/31/07
The case is with an officer.

8/2/07
This petition is assigned to an officer on 7/21/07.

8/3/07
Case is with an officer. Decision to be made within 4-6 weeks.

8/9/07
Case is ready for an approval and currently with an officer. Completed all security checks. Waiting for a visa number.

8/17/07
Will order FP.
Everything else looks fine.
Wait for 2-3 months for the FP notice. Case is NOT with an officer.
 
Talked to TSC IO

I just talked to TSC IO. She was very nice.
Said..In their system there was a request for FP notice. But my local office appointments not available. As soon as appointments become available. System will generate a notice. Till then I have to wait. 2nd FP is only reason holding approval.

Should I go walkin to check my luck?
