GC leaving US more than 6 month

Dear All,

I got my GC last March and left US in July, 2006 due to family obligation. Back to US this Jan(2007) and applied Re-entry permit before leaving again(later Jan). Now I didn't get any information from INS about my Re-entry Permit. If my I-131 get rejected, Shall I have problem to enter US next time if I back after 6 month but within a year?

Could I say that I am waitting for Re-entry Permit as a reason if I am required to explain why I stayed outside US more than 6 month at the POE?

Try to make your stay away from the US less than six months. Technically, then the onus is on INS to prove that you abandoned your permanent residence. If you are out for more than six months (but less than a year), you have to prove that you didn't abandon your permanent residence. Of course, if you are out for more than a year without an approved rentry permit you loose your GC.

Having said that, I have seen additional questioning and even warnings of abandoning GC if you have lots of back-to-back five/six month trips outside of the US.
