Hi,
My recruitment period begun on Feb 22nd and ended on Mar 26th. My attorney promised to send my boss a format for workplace job posting.

I tried to keep my nose out the whole recruitment process. I did a walk around the whole office everyday looking for my job posting but nothing showed up. On Mar 16th, 10 calendar days before the end of recruitment period, I asked my boss about it. My boss contacted the paralegal who then sent format for the local job posting. I then printed it out and put it up.

Paralegal asked us to take the posting down on April 2nd.

So the job posting was on the notice board for 10 calendar days withing the recruitment period but 7 business days. It was on the notice board for another 4 business days outside of the recruitment period.

Questions:
  • Is the local job posting exactly per the rules? Or is it too short in terms of number of business days?
  • Is there any chance of this labor certification getting approved?

I really have had it the morons that pass for immigration paralegals in this country.

There is a section on the notice which is supposed to indicate the start and end dates when the notice was posted. This has to include 10 consecutive business days (excluding holidays). Even if the notice wasn't physically up (who's checking!), the dates on the notice should indicate correct duration. Can you get a copy of the notice that was included in your recruitment report?

I do have the copy of the notice, it mentions the dates as March 16th to Apr 22nd (the exact dates when physical notice was up). As per the dates on the job notice, it was there for 10 calendar days and 7 business days within the recruitment period. I'm not sure they'll lie about it.

Any hope left?
 
I got an explanation from the attorney about this situation:

She said they had an explanation from USDL that the posting has to start within the recruitment period. Has anybody heard of it?

As far as I can tell, it contradicts all the documents I've read so far. Also, it also contradicts the instruction in RI, which says, "The posting must: Remain posted for at least 10 consecutive days within the 30 day recruitment period."
