Primary I-485 file Got separated from Spouse – Any Experience?

Hi all,

We filed concurrently I-140/485 in sep. 2005 at Vermont Service Center and last year July 2006 our files were transferred to NSC. After I got my EB-1a approved my spouse 485 got transferred back to VSC. What I learnt is usually the files won’t be separated. Anybody has experienced and got approved?????

my case was transfered to our local office, but not my spouse's. and then we both got interview notice and went to the local office for an interview. my case got approved right away; but spouse has to wait for security check.

also we did file a lawsuit in october of 06.

Thanks for your input. By the way can you please explain how was the interview and your details regarding your category, PD etc. that will be helpful.

the interview is mostly the officer asks for documents and then puts into our files. asks many generic questions (such as rested before? legal problem before?); asks when and how we entered the US, when got married etc. All very simple and straightfoward. do need to prepare all the documents though.

EB2; PD is about 08/04.

was your case in Vermont service center and then it got transferred to local office (NY or NJ)?
 
yes in Vermont and then transfered to NY

My EB-1a I-140 got approved in Feb. 2007 and I have already got the approval of EB-2 NIW as well. As per EB-2 the PD is Sep. 2005 and since EB-1 is current do you think our case might be adjudicated? Our finger printing got expired (since it is more than 15 months). My NC is done and I came to know from NSC.

When I got my EB-1 approval my spouse 485 case got several LUDs after that it got transferred to VSC from NSC.

do you think it might be a good sign?
 
Now it’s time for you to make an inquiry with the National Customer Service Center. Then the Service Center will probably begin to review your case including scheduling an FP appointment.
