My I-485(Schedule A) was approved in Oct-06 in local office. Received green card in mail after 2 or so months. I went on vacation right after local office approved my I-485 and put I-551 stamp in passport on the same day.

I came back from vacation and joined work in last week of Jan-07. I was on vacation(out of country) for more than 2 months. Project my employer found for me ends by end of this(March-07) month. He will find me another project.

I think people advise to stay with the GC sponsor employer at least for 6 months after GC approval. Should my vacation be counted in staying with the same employer period? or I should calculate 6 months from the date I joined work after returning from a vacation? What would you advise to keep my record straright and worry less at the time of filing for citizenship?

FYI: My spouse's I-485 wasn't approved during interview pending FBI name check. After recend Infopass visit to local office we learned that FBI name check is cleared but as you know Schedule A is retrogressed and now he falls under EB3 so it may take years (unless congress passes something S.646?) for his approval. Would my departure(after completing 6 months after GC period) from employer will affect his I-485 approval?

Thanks

the 6 months rule is not written anywhere. some people say it should be 6 months some 2 months some 1 yr. there is no rule my fiend about when u can leave ur employer. it is an open ended subject.

agreed that it's open ended question but if you read Rajiv's "opinion" (sticky thread) and many other gurus opinion, it's advised to stay at least 6 months if not more?

one shoudln't be mechanical, usics never revoked a green card because u leave early ur employer. it is all talks and opinions but nothing written anywhere in a law. i personally talked with a good lawyer here and he told me you can leave whenever you want, and i told him about the 6 months and he said it is a matter of opnions, then i talked with another one he told me at least you should stay 1 yr. there is no answer simply for that matter, but if you wana wait, it is up to you. rajiv khana has his opinion and other people have another one.
