How to change from NIW to EB1b??

I have my NIW-140 approved about a year ago. But due to the visa retrogression, I can not turn in my 485 application.
Scared by the endless immigration backlog, I decided to apply for EB1-b in order to apply for 485.
I have seven recommendation/opinion letters for my NIW case, could you show me how to change those letters to the EB1-b format? I appreciate it very much if anyone can offer me one or two sample letters for the EB1-b applications. Thanks a lot.

Smile_rain,

First, let people know and understand about your terminology. What is Eb1-b? Secondly, you dont need to change the letters. Generally, letters written for NIW should work for any of the Eb1 category provided they were well drafted during NIW to also account for the different requirements of Eb1.
Simply having seven letters would not qualify for the Eb1, you need to have substantial weight in form of the evidences demonstrating your claim.

Hi, NIW-Nov 04:
Thanks for your reply. I am sorry that I didn't express myself clearly. I will apply for EB1-OR(Outstanding Researcher).
My NIW-140 application has been approved. Now I plan to apply for EB1-OR due to the visa retrogression for the EB2-NIW category. Just feel painful to change those letters from NIW format to fit into the EB1-OR category:-(

Smile_rain,

You dont need to change any of your NIW recommendation letters for Eb1-OR. Keep them same. Simply include key sentences from those letters that point out the requirements for Eb1-OR and also your outstanding research. Just submit the photocopy of those letters or if you have another original copy of letter.

One of the main requirements of Eb1-OR is permanent job offer !! Do you have a permanent job/offer from your employer? Post your qualifications and achivements here so that your eligibilty for that could be justified.

Hi, NIW-Now 04: Thanks for your reply very much. I have a permanent job offer from a research I university. I have published 20 papers and filed two patents(still pending:-(. In addition, I am a reviewer for several peer-reviewed journals in my field.

You dont need new letters. Old letters should work fine. Keep in mind most important letter is the one from your employer (appropriate authority in University) for Eb1-OR.

When I filed my NIW, at that time I asked for 2 ORIGINAL SIGNED copies of letters from each referee. I used first copy for NIW and kept the second one just in case I had to apply EB-1A later. NIW got approved, but....

You know what NIW priority dates retrogressed so I felt the need to apply for another EB-1A and then I made very-high resolution color-scan copies of the second original I saved. They had been dated 1 year old but they worked. My EB-1A got approved.

I still have the original second copy just in case.....................

Dear mogambo1:
You are sooo~~~~~~~smart. I should have done the same thing:-(
Thank your very much for sharing your own experience with us. I just have one more question about the letter. Since in the letter for NIW, there are such sentences as "xxx's pioneering research works benefit the national interest to a "substantially" greater degree than would an available U.S. worker having the same minimum qualifications." Don't you need to delete them? Or maybe your letters don't have similar words?~~

As I mentioned in my earlier mail, I changed nothing. ANd dont worry for thw word usage, even in my letters (I drafted for everyone) I used words "substantially" and "national interest" etc. They still worked. I think when one person is readin even if he gets some extra inromation like you are possess extraordinary ability but your presence is also essential in national interest, it makes better impression. I think it should not hurt if not do any good.

I am in the similar situation. My letters are now one year old, so I assume I have to get new letters right?

I asked for another copy of the same letter (NIW), some people changed the content, others sent the same with new dates. Most of them will do that, as long as they donot have to write one. So If you do not have the originals you can request another copy form the same refrees.
Good luck

Thanks, good_y.
The forum is very useful and helpful.^_^

Thanks, NIW-Nov 04. Thanks for your information. It makes me feel relieved now. Since I sent emails to several people who wrote the recommendation letters for my NIW application, only one replied and agreed to sign the new letter for EB1B for me:-( Reading your reply changes my mood from bad to great:-)

You can even submit a photocopy of the old letters. No need to even ask for new dated letters.

Keep smiling !

I made very high resolution color scans of my old letters and attached them along with my new EB-1a application. After printing on color laser printer a 600dpi scanned letter exactly looked like original including color letter heads which appeared almost real.

Just a suggestion. :p

smile_rain,

I would not advise you to spend your time in all that digital work when a simple black and white photocopy works without much issue. It is basically the question of trust, if they dont trust you they can ask you for originals or cotact the letter writters. If asked, you can always tell them that originals are with them only.
