I-140 approval, need urgent suggestions

Dear forum members,

I had filed my I-140 petition (EB1-EA), which got assigned to NSC (June 12, 2006). I never upgraded it to PP. After hearing so many RFEs and denial from NSC, I asked my lawyer to withdraw my case from NSC in january and was planning to reapply to TSC. My lawyer sent the withdraw letter a month ago. The status online never changed.

But today, my case has been approved by NSC. they haven't considered the withdrawal letter. my question is can i proceed with my I-485 with this approval? as they are really slow processing anything, can they still consider the withdrawal? can i withdraw the withdrawal letter?

I'm so confused right now...I can't even celebrate...does anyone have any suggestions?

First of all congratulations on the approval, second dont worry at all, as long as you have an dget the 140 approval your on the other side, ur attorney will knwo what to do, I dont see why i can't file 485 with your approved 140. As long as its approved no problem at all..

congrats again!!
 
thanks tipotodo. I hope you are right.... i never thought this would be approved. lets see what my lawyer does.

Congratulations eb-1query.

Make sure that your lawyer has not withdrawn your case. Is it very recent. One way it is good that NSC does not care about the letter that we send for enquiry/status check/NC check. Is there any proof that they received your attorney's letter?

don't worry and you goahead and file your 485.
 
Thank you all. Still I'm not 100% sure. I just think the withdrawal letter didn't reach the file. what if they find it now and cancel everything....
In retrospect, I should have never tried to withdraw it....but I did not think I had presented my case as strongly as I should have...
