I have been reading lot of good things about you.
I have a situation here where i need to legal advice.
My 6th year H1b peried expired on Nov 13 2006. Since i had approved
labour I applied for my and my wife's 7th year H1 and H4 extension on Nov
12, 2006.
I applied my I-140 prior to my I-485.
In june 2007 I-485 became current, so i applied my I-485 while my 7th
year H1B extension was in pending status.
In October 2007 we (Me and my wife) got our EAD. Nov 2007 i got my H1B
approved but my I-94 was not approved, because of that my wife's h4
extension got denied.
My lawyer suggested us to change to AOS and not to worry about H1B and
H4 anymore.
Jan 2008 I got my Advance Parole approved, but my wife's AP got denied
saying her H4 expired on Nov 2006 and we applied her I-485 in June
2007, so from Nov 2006 to June 2007 USCIS is considering her as
out-of-status. My lawyer re-opened the case and also applied for a new AP for my
wife.
Feb 2008 i got my I-140 denied, still waiting on the reason.
In this case what are my options.
1. If i do MTR on my I-140 case can i work legally using my EAD, how
long can i work?
Please advice.

The Burning Problem
Long wait times of 5-10 years for EB2/EB3 Employment based greencard applicants from India.
Please convince TODAY as many friends as you can to become proactive in participating in the campaign for getting Green cards faster. Pass this message to as many as you can (students, H1 holders, spouses etc), and ask them in-turn to do the same and take action.
The new government is willing to hear us unlike never before.

2. And you can submit your ideas here http://change.gov. You will be asked to register. Please do it with actual details with no fear. We are legal here and many of us have done it, there is nothing to fear. This is just one way to start.

The details:
So far, there has been much action or participation on addressing the problem. This is totally unacceptable, when the issue affects 400-500,000 of applicants but those fighting for this cause are very few. This issue needs your support.
We are legal immigrants who bring innovation, create value, build companies and jobs, and contribute in many ways to the economy. The system was fine 4-5 years back, but now it’s severely backlogged. Do not think “it is not my problem now”, because you will be also effected by the negative impact. Reports say only 5000 people are voicing their opinions, even though the problem affects more than 500,000 applicants (and their spouses).

We just need a small administrative fix to recapture the lost visas and also make sure the system respects skilled workers and their interests. If anyone does not know what EB2 EB3 is, please explain to them. We need to request the government to make the waiting period no more than 5 years of being legally in the US, and to immediately bring relief to EB2/EB3 applicants from India by clearing backlogs. Remember that you will be at the end of the line, if you did not yet apply. Right now undocumented workers are raising more voice, openly.
Immigrationvoice.org is one good site to participate to name one. Let’s help ourselves and each other. Also register in this site or any other, and start contributing your ideas for your own good.

My 140 was denied on ability to pay, my company which is ver very small household business refused to file the MTR/Appeal.
At present on EAD, I-485 pending.

What are my options now?

Labor PD: Nov 2003.
Labor approved: August 2006.

AS MY SENIORS I NEED YOUR SUGGESTIONS HELP.Any phone number or email id appreciated.I AM REALLY TENSED
 
filing MTR/appeal you may not get approval unless valid financial statement or amend previous tax returns of company.

But with MTR filing you can get time as it will be referred to AAO as SOP.
mean time you can work on other options.
