Opening case after 10 months

Gurus, Question for you.

I had applied for my LC in Dec 2001, EB3 Non-RIR from Company A. After leaving the Company A in April 04, my Company A received the 45-day letter in Dec 05. At that time I was in India visiting my family. So, my employer didnt send the 45-day letter back to USCIS, by which my case was closed.

Now, I want to know:
If I can open the case again after 10 months.
If Yes, and If I can join the company A, can I continue my I-140 from Company A with the same labor.

Please help.

P-XXXXX-YYYYY

Part 1 - P or D
Part 2 - XXXXX - Part 2 (year and day of the year, when the case was entered into PBEC)
Part 3 - YYYYY - Running seq. no , gets reset to 00001 , when it reaches 99999. gets carried over between years.

If you analyze the ETA numbers, first digit (YYYYY) of part 3 is always greater or equal to, if Part 2 (XXXXX) is greater, (esp, the last 3 digits of the Part 2) when two ETA numbers are compared from the same year

Great studies for the numbers. My ETA case # fit that too.
Gurus, would anybody be kind to tell me how to get the screen shot many people mentioned here in the forum. I am new here and please forgive my ignorance.
 
It took about 130 days to enter the first 100k records, then
40 days for the next 100k then 30 days for the next 100k. Show how PBEC has improved its efficiency. The first 130 is a over kill.

I have a question about EB2 vs EB3. Will you please answer?

My question is:

My employer filed my Labor petition in 2003 and that petition got approved yesterday Oct 18, 2006. I have Masters Degree from India and I have about 10 years of IT experience.

I saw in the Immigration Portal forum that all the people classify their cases as EB2 or EB3 even before their Labor is approved. I asked my company's legal person, who prepared the paperwork for my Labor Petition, as to what classification (EB2 or EB3) he filed me under. But he says that only when applying for I-140 do my case get classified and until Labor is approved there is neither EB2 nor EB3. I am not sure if that guy is right.

I would greatly appreciate if some kind hearted member in this forum could send an email to ababu27@hotmail.com and give some advice about this.

It is not what you have , it is about what the JOB requires. You may have Phd, but if the job requires only UG degree with 4 or less exp, then your job qualifies only for EB3.

Check your ETA section, look for Job requirments, that would say whether it is EB3 or EB2.

Your HR guy may be correct. there is a probability for DOL to reject the EB2 category while processing. Like you cannot ask for MS + 2 for a junior level position. That would be sent with NOF.So unless it is approved, it is not certain that your ETA is EB2 or EB3.

Check your ETA document.

So if I understand this correct it was entered on the 289 th day of 2004 or more precisely October15, 2004.
What's up with the rest of the numbers?
His made it from SWA to regional in 6 months and was it not for this crazy PBEC system we would have been out of it long time ago. Because the old system was working pretty good here in PA. One of his collegues started the process exactly 1 year before we did in Feb 2003. His went from SWA to regional in August of 2003 and by the time we started in Feb of 2004, this guy had already had his medical done and fingerprinting. So we thought ours would be as smooth as this one. But gosh were we WRONG!!!!
I keep on checking the boards and see people getting certified for PD Jan 2004. We are Feb 2004, but I am not sure about this RIR or non-RIR.
Can someone explain that to me. All I know is that his employer had to run the ads in the different papers advertising the job.

If the employer had to post ads then your application is in RIR queue.

But one field added from the last update is " Case Status : Final Review". Does this mean anything in PBEC world. Are there any missing fields. Find my Case details below.

Greeways/other member - Can you tell me where in the Screen shot do you see the case status? In my screen shot from Sept, i see all the fields entered above except that there was no field for case status. However, when i called the 202# the guy told me that it was under final review, but that was 1.5 months ago :confused:
