As you know PBEC will take another month to to post NOF. Our great Law firm might take another 10 days. PBEC will take another 2 monmths to enter and another 3/4 months to approve and by that time we get the approval letter, it may be another one year from now. By that time whatever GC's numbers USCIS issues will be used by all others and we will be again left with no GC's.

NOF received today.

Hi,
I got following NOF.

NOF: Recruitment results incomplete

"48 out of 54 applicants who responded were rejected wihtout being offered an interview. The remaining six applicants were identified as qualified US. citizens and given intreview for the position. The employer has not given specific, lawful job-related reason for denial. In response to this findings employer must submit a revised statement of recruitment results."


Please help he your thoughts to rebutt this NOF.

Also murthy.com says, "The cases will be subject to current rules that require offering 100 percent of the prevailing wage, rather than the older system that allowed for an offer of 95 percent of the prevailing wage."....Does that mean they are going to check if rate of pay is more than or equals to prevailing wage.......

Do they check the rate of pay against the prevailing wage when our labor was filed ? Or do they check against the prevailing wage as of now. I guess, the prevaling wage keeps changing every year or so.....please do let me know...

There is $2000.00 difference in my case, should I expect NOF?
