Hi,

I don't have a birth certificate and I had sent 2 affidavits (Signed my parents in Rs 10 Stamp Paper and notarised) to our attorney for review. Below is the response from the Immigration Specialist. Is this valid or not? I just have a few months (4 months) in my H1 and i'm wondering whether it is a must to get it from the local magistrate.

"Because you were both born after the time that registration of birth was required(1970), we will need either a copy of your birth certificates or an affidavit from the local magistrate indicating birth certificates are not available."
Hi I had a similar issue for an RFE. There is a comapny run by ttk services pvt lts who will do it for you from India and in about 3 week's time.Their web site is www.yourmaninindia.com and they charge about $150.00 + mailing per Certificate. You may want to try this offer if you have about 4 weeks of time or get it early by paying more !!!!
Thx
Any questions >> vkulkarni70@hotmail.com

If the issue date of birth certificate is 1999(registration date), then it's better to have 2 affidavits from close relatives(not father and mother)

Please Help:Birth Certificate with No Name (has other details)

Hi,
I have a birth certificate which has most details - date of birth, father's name. It is missing my name since I was not named at the time the birth was recorded.
I have obtained an affidavit from my parents (notarized). Will the birth cert.(without name) and affidavit be sufficient or will I have to provide any other document ? I cannot provide non-availability certificate as my birth certificate is available - just that it doesn't have my name on it.
Any help is greatly appreciated.
Thanks in advance.

Single Affidavit or two sparate affidavits?

Hi,

A help will be great.

Birth was registered in 2004 in government office while actual birth year is 1974

Hi,

My birth year is 1974 but My parent registered my birth in the year 2004 in Government office(Muncipal corporation). Birth certificate issued by govenement office says birth date registration as 2004. Do I have to submit any additional evidance to avoid Birth Certificate RFE at 485 stage because it was registered in 2004 rather then 1974 in government office?

Thanks for your time.

Birth Cert with first name only

I have a birth certificate from the muncipality. The birth was registered soon after I was born and my parents named me before registration so there are no issues as far as late registration or "no name" is concerned. The only concern I have is that the birth certificate mentions only the first names of me and my mother although my father's full name is mentioned. Will this be a problem. The muncipalities in India register the birth in this manner, their explanation being that a child's full name is his/her first name followed by the father's full name. Similarly a married woman's full name is her first name followed by the husband's full name. I know this is not necessarily true in the USA. So I was wondering if this might be a problem. Is there anyone in this forum who had a similar situation and their certificate worked.

Thanks
BlackHole.

My birth was not recorded in local municipal office in my home town.
What is the procedure to get the birth certificate.?

Thanks.

Some where on the USCIS site it says that in absence of primary evidence of birth (birth certificate), one can submit secondary evidences such as:

1. Affidavit form two individuals (mom, dad, uncle). You can add line in the affidavit that birth certificate is not available.

2. You can also submit your high school/ matriculation certificate if it has your DOB (english translation).

3. Copy of passport showing your DOB.

I did submit all three and explained in the cover letter why I was sending all this document as support of birth certificate.

This has worked for me without any questions being asked. It all depends on concerned officer who is reviewing you case!

But try to give everything you have to proove your case.

Goodluck

get affidavits

Hey Guys,
My BC was recently registered (Nov 2002) and i've received RFE.

To respond i have made two sworn affidavits (one from father and the otehr from aunt). In addition i've sent couple of certificates from college stating dob.

Getting affidavits took me 3 weeks so you guys better get these and send it along with your I485 application ... or you could get RFE later.

Notice not delivered?

Hi Gurus,

Need some help/input.
Got this message in USCIS website re: my case.

"On May 18, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent."

I have received notices re: my case (I-485) before at this mailing address. Too late in the weekend to call...anyone had a similar situation before?

Also, what could this notice be? I am just paranoid. Just did my FP last week (that notice made it fine)...

Thanks guys

Birth Certificate question for 485 processing

My Birth certificate doesn't have my name on it. Also, the place of birth has the street address in it. I have heard that it is possible to have a birth certificate issued by Indian embassy in the US. Would this BC suffice for 485 processing? Would appreciate a response!

Question on the name in the Affadavit

I have a question on the name. Should the Family name be First followed by First name and then middle name.

Eg: Koppula Srinath Babu

(Family name : Koppula , Firt Name : Srinath , Middle Name : Babu).

Should the name in the Affadavit be in this format ? like Koppula Srinath Babu or should be it Srinath Babu Koppula ? ( IN US the family name is your last name). People from A.P will be having this issue. PLease help me in this reragrd

In all the applications like 485/EAD/AP, the family name is the fist column and then followed by First and Middle names.

Place of birth

I am from India, born after 1970.

In my passport my taluk headquarters has been recorded as place of birth.
But in my birth certificate registered during 2004, my village has been recorded as place of birth. Distance between the 2 places is around 3 miles.

May I know whether this difference will create a problem, if so is there any suggestion to overcome this?

Thanks in advance
