Thanks for your advice! I was skeptical about approaching my congressman's office but I did anyway. The person looking after my case at that C's office is kicking INS butt! She asked why it was taking sooo long. The INS told her that my wife's fingerprints had expired and that they will issue a new fingerprint appt. I fired back an email to the C's office stating that my wife's fingerprints had NEVER been accepted and had been rejected twice - last being rejected in NOV, 2001. Further, I stated that the Kansas City INS told my that they only do 2 fingerprints and if they are both rejected, an face-to-face interview will occur. Reason being - fingerprints that are reject twice have a very high probability of being rejected again. The C's office is on INS butt again asking why this discrepency and wants a quick answer.

My wife received a fingerprint notice and it is scheduled for September 18, 2003. Her last two fingerprint sessions were done back in 2001 - both rejected. The C's immigration specialist is on vacation until Sept 7.

The BCIS told the C's office that my wife's fingerprints had expired, which is a buck of crap - they were never acceptable to expire. Then after 2 years (yes, 2 years), the BCIS decides that my wife needs her fingerprints to be redone again. I believe after 2 rejected fingerprintings, they just move the case to a local IIO, as per the senior INS officer at Kansas City INS.

Just another stall tactic by an incompetent BCIS!

Fingerprints

Just an update: My wife had here fingerprints done and the FBI has already returned them back to the BCIS for file-matchup. The congressman's office said they will enquire of the BCIS on Oct 1 regarding our files. At that time, the c's office believes that they will expediate adjudication.

Let's wait and see. I haven't heard if the BCIS is going to have their internal audit this year. They usually have in in September or at the beginning of their fiscal year in October.

Update as of Nov 13

Our files were requested and sent to the Kansas CIty CIS for some obscure reason in April, 2003, while the CIS website had the same message. My congressional liaison is now trying to contact the KC liaison (by phone and fax) to enquire why the KC office needed those files since my wife and I moved to Seattle in March, 2003. We also know that my wife's fingerprints are good so all we need now is for an IO to review the files and stamp it (if they ever find the files). :rolleyes:

and hearing very nonsense stories!! It just doesn't make sense at all!! whenever or whoever ask them they say: IT IS UNDER NAME CHECK. It has been more than 7 months and it is getting dust at a corner if not lost already. aghajan
 
Transfering to Local Seattle INS

Here's the scoop... Since my wife and I were married for less than 2 years, I-485s must be locally adjudicated. The Kansas City INS is transfering our files to the Seattle office ubt may be adjudicated at the NSC because we have been married for over 4 years. This may sound like nothing but this is a breakthrough for us. I hope the Seattle office acts quickly on our files.

Interview at Seattle

Ladies and Gents,

Through the efforts of the local congressional office, my wife and I have an interview with the Seattle INS on Jan 8, 2004. We are to bring our passports, appointment letter, cohabitation info, employment letter, immigration documents of past processing, and old EADs.

This should straight forward and I'll let y'all know what happens!. This is LONG awaited news for us.

Conclusion

Well, ppl, this entry concludes this thread of 2000 waiters (as I beleive I was the last one). My and my spouse's application was approved on Jan 27, 2004, at the Seattle USCIS. I will list my details in the main channel. To all those who are waiting, your day will indeed come and I hope you do not have to wait 3.5 years like I did!
