I wonder who do we turn to when gp111's case gets certified and he leaves this forum :(

When I called the DOL AVM recently, it was listing all the cases numbers as 'received' as before the transfer. Do you guys know which number you called to get the recorded message about SF DOL transferring 20000 cases to BEC? My attorney just asked me for the source of this info, and I'd like...

Absolutely!! I don't know what you do for a living, gp111, but I'm sure you'd make a great immigration attorney, better than most of what we guys have :)

If Line 14 of ETA750 (the labor cert form) says either a Masters dergree or BS+5 years experience, then you are considered a member with "Advanced Degree" (using INS' language) and this makes you eligible to file in EB2. Look for a document that gp111 had sent out earlier on this thread; that...

You are still on the same non-immigrant status even after 140 is approved. You can use portability only after 180 days after 485 is filed.

gp111, Folks on this forum really appreciate your informative and helpful answers. I just found an answer for the question about whether H1-B visa can be extended when 140 has been approved but 485 could not be applied because PD is not current. Looks like it can be done, and in 3 years...

gp111, H1 can be extended on the basis of a pending 140. But in a situation where the 140 has been approved (and therefore no longer pending) but 485 has not been applied or pending because the PD is not current? Is it possible to get H1 visa extensions in this situation?

OK, here is my interpretation: [you may say biased :)] Remember, this is a clarification of DOL to AILA, so you should interpret this in the context of the original memo.

Here's a subtle point about EB2/3 that I'm sure will get asked many times in the days ahead... I'm told that the case will qualify as EB2 only the labor specifically required Master degree or equivalent (line 14 in the form ETA750). If the applicant does not have a masters degree, but has...

gp111, Thanks, again, for your informative answers. I believe the first line is a typo...you must have meant "One cannot apply I-485 if the Priority Date is not current ". In this case, how is the concurrent filing of I-140 and I-485 affected if the PD is not current?

gp111 and others who might know the answer: 1. When the PD retrogress happens, is there a PD each for the 140 and 485 stage, or is there just one PD for both? 2. Once the PD retrogresses to, say 2002, does it usually get better or worse? That is, is it possible to move further back to, say...

You are right - we all tend to view/interpret the memo in a way that sounds favourable to us :) Having said that, CA/SF SWA/DOL is one of the most backlogged in the country. A DOL RD date of Mar 2003 (currently being processed) transaltes to a SWA PD of Jan-Mar 2002 since it takes an avg...

gp111, Good point. But when they say 'SF-FLC' do they mean the DOL office (which handles cases from all states) or the California cases only?

jayjo7, I hope I'm wrong, but cases like yours or close by DOL RD dates could actually be adversely affected by this. If SF-FLC transfers all non-open cases, and if a case like yours just happens miss that deadline, it will get transferred to BEC and will wait for the national RD to catch up...

gp111, I also heard that Philly DOL (now BEC) will ramp up from the current staff of 10 to 120 !! But did you mean each office or each officer will approve 20 cases/day?

Count me in to for support... Abt the news on BRC: is it true that the BRC will give priority to the respective DOLs over other DOL's cases being handled by that BRC? For example, Phily BRC will first look at Phily's DOL's cases before opening SF DOL's cases? That's so unfair if it's true!! :(

My LC was transferred around Feb-end 2004, and only recently did it show up in DOL AVM, after almost 7-8 months. Call AVM, options 1, 2 and then enter your employer number (the number that was filled in the LC form) and it should tell you all the LCs from your employer currently at DOL...

    H1 Visa stamping experience- Canada

Proass999, I stayed at a Quality Inn (called Quality Inn Airport) which is ~6 miles from the consulate. I met another couple at the hotel who had also come for the visa stamping. If you read the documents at the Vancouver visa office carefully, it says you can get a new visa if the old...
