If Line 14 of ETA750 (the labor cert form) says either a Masters dergree or BS+5 years experience, then you are considered a member with "Advanced Degree" (using INS' language) and this makes you eligible to file in EB2.

H1 can be extended on the basis of a pending 140.
But in a situation where the 140 has been approved (and therefore no longer pending) but 485 has not been applied or pending because the PD is not current? Is it possible to get H1 visa extensions in this situation?

In this case, how is the concurrent filing of I-140 and I-485 affected if the PD is not current?

I hope I'm wrong, but cases like yours or close by DOL RD dates could actually be adversely affected by this. If SF-FLC transfers all non-open cases, and if a case like yours just happens miss that deadline, it will get transferred to BEC and will wait for the national RD to catch up...

I also heard that Philly DOL (now BEC) will ramp up from the current staff of 10 to 120 !!
But did you mean each office or each officer will approve 20 cases/day?

Abt the news on BRC: is it true that the BRC will give priority to the respective DOLs over other DOL's cases being handled by that BRC? For example, Phily BRC will first look at Phily's DOL's cases before opening SF DOL's cases? That's so unfair if it's true!! :(
My LC was transferred around Feb-end 2004, and only recently did it show up in DOL AVM, after almost 7-8 months.
Call AVM, options 1, 2 and then enter your employer number (the number that was filled in the LC form) and it should tell you all the LCs from your employer currently at DOL...
