U can file a EB2-PERM separately with the same employer. It takes maximum 45 days. Apply I-140 immediately(if possible premimum). That will get you 3 years of h1B extension. There is a huge hope that CIR will come thru in some form or other, that way you are ready for I-485.

I think you should consider moving out. Even if you get your labor certified the EB3 backlog will hold u for another 3 years(assuming no CIR) and then 485 for another 1 year. So 5 years there again. if you are really frustrated with the people there, consider this :

I feel like home here, so much so that I do not want to go to any other thread and ask this stupid question.
Can I apply for I-140 now and wait for 3/4 months. If it doesn't come through by then convert it to Premium processing ?

My prayers for you. Some ideas , u might want to consider.
1> What is the reason of not following up with the 01 cases ? Is it loosing you ?
(If nothing works)
2> Try the new I-140 approved. Your PD would be locked.
3> Get a 3 yrs extension.
4> Change job, if u want to...
The safe route would be :
>> Apply PERM before joining the company.
>> Get H1B transfer and join the company.
>> Apply I-140 in Premium processing.
>> You would be ready for 3 year extension.

I talked to my attorney day before. Should we consider RIR conversion ? I asked. He doesn't recommend it. I basically don't trust BEC, he said.
