My friend was illegal for a while. She came as a student and lost her status. She was merried to "mulla" arab men older than her about 2o years. She was in hidjab and was living to fit his demands. He had a 5 kids from previous marriage and they tried to undermine her in many ways. He puts her limits in food and going school or having DL. Actually she was quiet modern before and could not bear it long time. Just before her interview she had a quarrel again with her husbund and left heartbroken him. He accused her in paper-based marriage and fraud. That he spent a lot of money on her to buy jewelery blabla bla. Later in about three months she met a young guy about 29 y.o who was in love with her. He tried to get her attention and took her out. Since he was very nice in contrast she agreed to marry him. But this young guy called her ex-husbund, who started poisining him with telling that she is looking for papers and etc. Unsure he asked her to leave and accused in same things. Sorry to say but she left him bec she was already hearted enough by her life. Later he came back asked forgive him and start again. My friend said that she can't do it and better to stay on her own. But the guy reported to INS and they are asking her to come to the court for deportation case. Probably she accused in many other things that her refused guy tring to hang on her now. Like expenses he did on about 5000$. I a not sure how to help her.She is strong enough but young to be beaten by man like this. Man are so low in thier acts. They have f***ked her and now wants to destroy her too. I want yr help, I am sure she can meet s/o later and settle her life but not playing under those men games.
She would not mind going back, but in our country girl like in her position is stigmatized to the worth. She can't fit society and will suffer more. And also she changed her values temporarily to stay on her own and pursue education here.
Please advice how can she deal with this accuses. She has SS# and work permit for a year.

well your friend needs a good lawyer very quickly. This sounds like a VAWA case is she can prove it.

She does need a good lawyer very quickly.

VAWA cancellation of removal may be her only chance, but this doesn't sound like a strong case unless you're leaving out a lot.

Her husband would NEED to be a USC or LPR, which is not stated. He would have had to subject her to battery or extreme cruelty. There is no mention of battery. The situation described may not be extreme cruelty if she was being expected to live according to fundamentalist Islamic expectations for a wife, which were probably well-known to her before she married a mullah--and by the way, she would have to show that the marriage to said mullah was bona fide. Finally she would also need to show that removal would cause extreme hardship. "Changed values" alone is not extreme hardship.

She might have a case, but that is not clear by any means and she needs a lawyer fast otherwise it will be too late. Factors that might help would be if the marriage was coerced, especially as a minor, and if her overstay of visa was due to her husband forcing her to quit school against her will.

Abuse comes in so may forms including physical, emotional, medical, economical and mental. All are taken into account in a VAWA situation not just the physical.

BUT with a case the complicated one word VERY GOOD LAWYER oops thats three words.
