dear all,
need an very important suggestion and experience from you guys, my friend is an i245 and as he is told that he can do any kind of means that it does not have to match the labor cert, until the gc is approved becasue the labor is for the futer emplyment, anyway he is doing the job of labor cert with the sponcering employer for last 4 years, and his case is transferred to local office for interview which is not received yet and may now be comming for years now since the visa problem,.
would like to know if he can go to some other state and do some different job, but still continue the gc thing with the same emplyer, as he would still have the futuer job with the same sponcering emplyer after getting the gc, please give us some guidience on that, and also since changing the state, and updateing the address, would that trigger transfer to the ather state, please advice how does it go, as he would not like to find or work for a new sponcer just like to work over there till the gc process is over. your advice would be apprecaited
 
Not sure what your question is. For one to be eligible to file under 245(i) the labor certification must have been filed in his name (or in some one's name to whom this person is a derivative beneficiary) and must be filed post-marked before April 30, 2001. The person must be physically present on Dec 21, 2000. The labor cert must be approvable when filed. Whether it is for future job/present job does not matter.
