You Knowledgeable guys please through some light on this RFE Situation:

Hi all,

Welcome. Greetings!

One of my friend\'s situation goes like this. Her attorney received the RFE some time ago and planned to send in the Evidence requested before the dead line which is a week ahead(the reason being waiting for spouse\'s I-485 Receipt). But at this point of time the attorney is NO where to be seen(not responding). So at this point of time she is wondering what are her options with a week left to respond to the RFE.

1). Everything is okay, the current attorney sends in the Evidence to INS on-time - which will be a good thing to happen.

2). No answer from the current attorney. In this situation, what is her OPTIONS?

         - Can she get a copy of RFE letter from VSC by calling them? Will VSC respond on this (Or) has to go through a New Attorney?
   
         - Can she respond to that RFE by \'HERSELF\'? She just knows what has been asked in the RFE(based on the e-mail received from the current attorney), but DON\'T Have the copy of RFE letter.
   
         - Can she ask another new attorney to resolve this issue? If so, can the new Attorney can get the Copy of RFE from VSC? Will they respond to him/her?
   
         - Is \'Response\' should be RECEIVED by VSC before the dead-line (OR) has to be POST-Marked in the mail(ie. Has to be mailed out on any day before the dead line)?

Your insight thoughts would be helpful for her, if you had any similar experiences.

I would call the IIO and inform them about the situation. At the same time, I would send a letter to VSC via overnight delivery explaining the circumstances and requesting for more time.

I would first confront my attorney and ask the reason for not sending
the RFE. Then hire another attorney immediatly and ask for opinion.

1. Call the IIO and inform them about the situation.
2. She can reply to the RFE by herself. But she needs at least a copy of the RFE to be sent along with the documents requested.
3. If she wants she can hire another lawer , but I wouldn\'t advise it since it may take another 2-3 dyas to get things organised with the new lawer.
4. Hope she is aware that INS will never extend the time to reply RFE. If they don\'t get the reply on or before the date specified , her application will be considered as abandoned.

5. Can I ask you a question ?. Why did she wait this long to reply the RFE ? Ask her to act quickly !!!.

6. I really surprised that there were nobody to advice you girls little bit about the notorious way INS processes the applications.

Good Afternoon. Thanks for your insight. I have the answer and few questions for you.

Ans: She waited for so long, in order to wait and see whether she can get the I-485 Receipt for the Spouse(For GC Linking purpose).

Q1: Can she call the IIO(VSC) and ask for a Copy of RFE to be faxed/mailed to her?(if she can\'t get hold of the attorney).

Q2: Is\'t okay, just to send the documents asked for by VSC if she CANNOT get a copy of RFE?

Q3: Is\'t enough if the "Evidence" for the resp. RFE is sent out in MAIL before the dead line (Or) has to be received by VSC Before it?
