Gurus,

My previous company tried to substitute me on a pre-approved labor. The company received RFE's (concerning finances) and finally a denial. The company's lawyer then sent my case to AAO for review. I quit and joined my current company who filed PERM application. I recently received approval on PERM application and am about to file 140. I dont what i should answer for the question "Has any Immigrant Visa Petition ever been filed by you or on your behalf?". Kindly advise.

Has an I-140, I-130, or an I-485 ever been filed by you or for you? If yes, then that is your answer.

LC is not an immigrant petittion.
 
Yes. I-140 was filed earlier and RFE's pertaining to finances were received. Eventually, after responding to the RFE's, petition was denied. The lawyer then sent an appeal to AAO and i quit the company immediately after. My question...Is it necessary that i mention this in my current I-140 application? If yes, then what details should i give? Will this have a negative impact on my petition? Kindly advise.

Answer should be Yeas and fill in the employer name who has filed I-140 in the box next to Yes/No.

Yes you should mention it. It should not have an negtive impact. If you don't mention it, then that is considered lying, and they could deny your whole appliction just for lying.
 
Hi,

My lawyer is working on filling the form I-140 now and I am going to file for H1 9th year extention - I129. Do I put a yes or no on form I129-Part4, question #7?

Also on Part 4 - Processing Information, question #5:-

Are applications by dependents being filed with this petition?
Do I put a YES or NO if I am attaching Spouse's I-539 ?

Please help. Thanks.
