BCIS says that they will stop giving unnecessary RFEs to avoid backlogs. You will laugh at this.
My ND is 09/25/2003.(Concurrent. 140 approved in April). I got married in Feb and we applied for my wifes EAD and AP on May 5th. We also finished finger prints and cleared by FBI the same day. My wife got EAD on June 23. Today her status changed for AP. They issued an RFE.
I am still on h1-b. The visa and I-94 are valid for 1.8 years more. I am not using EAD right now. My wife is also on h-4. We do not know what the RFE is for because it was issued yesterday.
Why RFE on AP ? They could have issued RFE on EAD. EAD came fine.They could have simply rejected if they thought that there is a problem or some thing. After all she does not need AP because she has H-4 valid for two more years. What they are trying to achieve here ? I don't understand.We do not mind this, but am thinking if BCIS wastes time on issuing RFEs for things like this When will they clear the backlogs. (NSC by the way)...
Any Guesses ? Does this happen randomly ?
