Before u can jump into conclusions i just wanted to let you all know that this is an Age out case.........
RD - FEB 15, 2002
ND - MAR 15
EAD - APR 8
FP - MAY 23
PROCESS RESUMED - MAy 31
APPROVED - AUG 13
HEARD ON AVM - AUG 14
Now everybody around here might be thinking that i got lucky..... but hey just read my dad's entire process....
It all started in November 1997. He filed Regular labour EB3. At that time his company did not endorse RIR. It is like JAN 1999 and his company starts endorsing RIR. My dad then calls up the attorney and his attorney tell him that he will loose 2 years of Priority Dates and also he will loose some grandfather in rule or something like that if he reapplies. My dad thinks that about it and doesn't reapply (at that time RIR labour was taking just 3 months).
But hey guess what the PD's go all of a sudden to Current in MAY 99'. My dad calls up the attorney again and asks him to reapply. this time around he tells my dad that when the current is gone it will go back like 5 years and he would loose his PD again. this never happened because the PD just went back like a year or so....... so again he drops that idea..... finally in like JAN 00', he gets his call for ad's. HE posts ads in the newspaper and to his bad luck 4 ppl apply..... so now his entire 2 years of waiting patiently is all gone in the drains.
He then reapplies labour under EB2 RIR (if he had done this the first time around he would have got his GC by now). But hey still his bad luck looms. Hi labour gets approved hurray, BUT that attorney looses the approval notice. He requesets for a copy and that delays the I-140 by 6 Solid months. Now finally in JAN 02', 4 years after he started his process he gets to apply his 485. BUT still his bad luck insists on him... His attorney sends papers to INS in JAN. But my dad doesn't hear anything from the INS till like MAR. Then the attorney calls INS. This time it is the INS which looses his file..... they ask him to call back after a week and after a week they tell him that they found the file and they have assigned it a RD of FEB 15 when it is supposed to JAN 15 actually. That was the end of my dad's bad luck period becuase u guys know by now what happened.............
All this frustration and years of tension for a piece of card. I added a little bit more tension during this entire process because i was aging out soon. I am like 20 now going to be 21 soon. But we got lucky at the end.
This stretched up GC process also cost my DAD like $40,000.00 because he had to pay out of state tution for my education. But anyway i dont know how lucky my dad feels... But i am the most lucky person in my entire family........I owe a lot to him...
