Yahoo…. I-485 Finally Approved - Almost 5 years of wait time.

EB2 – Labor Substitute – PD 2006
140- filed Dec 2006 ( Requesting PD should be ported)
I-140 Approved - January 24, 2007 (converted from Regular to premium)
Bad thing - PD not ported
My Attorney sent email to USCIS(140 PP dept) asking them to give me benefit of earlier PD. The email from my attorney was forwarded to the adjudicating officer. No response from them till date. After waiting for more than three weeks, We request VSC to adjudicate the case by attaching the OLD I-140 in EB3 and new I-140 in EB2( even though it has no Old PD). Attaching the PD portability law.

After that I see a Lud on 02/24 and 03/01 after that nothing.

On March 13th I made a status Enquiry, they said I will be notified with in 30 or 45 days(not sure no of the days)

March 22nd issued an RFE , on my Medicals and prospective Empl Letter
March 29 received FP Notice(code3)

FP completed on Apr6th.
RFE mailed on Apr 7th received by USCIS on 9th.
LUD on Apr 10, 11, 12

485 Approved May 14th. Received emails this morning at 9:25 AM “we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE”

congratulations! enjoy the freedom! Just completed my FP2 (code 3) on May 12. Hope to hear something positive soon.

Same old boat

Dear Friends,

We got back into the same olden days when there is no retrogression whatsoever. Given that the the advances for EB3 and EB2 are too much, now the rule FIFO might not work like before because now USCIS has embraced too many Applicants making them Eligible for I485 Adjudication which is good and bad.

Now people with earlier PDs meaning 2002 or late 2001 may not get their GCs ahead of the folks with PDs in 2003. No offence to friends with 2003 PDs and Later 2002 PDs. But this is the reality.

So, older PD Folks shouldn't get surprised if you see younger ones getting their GCs ahead in the game. It might also happen that some folks might get their GCs in the next few months and the Dates might once again go back in the Fall of 2007 and we will go back to our cubicles siphoning our blood to our dear Desi Employers. I am not trying to be pessimistic here but these are realities with USCIS.

I was undergoing 5.5 years of agony and pain like the rest of our friends. The journey though painful but kept me busy by donating blood to Employers on a monthly basis. I now hav no blood left except some White blood cells. I am looking forward for some blood transfusion once I get my GC.
