I am giving below the details of my case. I will really really appreciate if all of you can please provide your valuable comments. I am very tense since yesterday after getting the email for case xfer.

Here are my case details

1. Joined Company A in June 2000 on H1 (First H1)
2. Company A placed me as a Consultant with company B
3. Company A filed for labor and subsequently I-140
4. Left company A and joined company B in Dec. 2001
5. I-140 got approved in 2002. Negotiated with company A to continue GC process
6. Filed I-485 and EAD in March 2003 through company A (I was still working with company B at that time)
7. Left company B in March 2004 and joined company C on EAD. Subseqently company C filed for H1( because EAD took a lot of time for renewal) which got approved and is valid till May 2007.
8. In March 2004 when I switched to company C I tried to find a project through company A (I have a couple of emails regarding that) but it did not work out.
8. I-485 Case xferred to local DC office on Nov 8, 2004.

I intend to continue with my employment with company C. The job responsibilities are the same as mentioned in LC.

Questions

1. How long would it take for the invw to be scheduled?
2. Can I use AC-21 in my case?
3. What should I expect in the invw?

I request you all to please recommend a suitable course of action for me.

Thanks

Hi ironklad,

In your case its simple your GC process is currently running with company A with whom you worked for a while during labour. After that you worked with B and right now with C. And now your intent is to continue with C after the Gc is approved. Luckily the job duties are matching as what is mentioned in LC. Thats cool. When you are called for the interview you can say that i want to use AC21 and continue to work with Company C rather than working with Company A. The only thing you need is latest tax returns from Company C and letter from Company C stating that they would like to continue the GC process during the time of interview.

Coming to the interview scheduling its taking anywhere around 4-10 months based on case to case basis.

My case is very similar to your case. My case is also transferred to local washington dc office on 23rd September 2004 and i am yet waiting for the interview schedule. Another thing is washington dc office is moving from Arlington to near by of DunnLoring Metro Station. That might cause some more delay.

There is nothing to be frustrated. I had a similar kind of feeling initially. After extensively searching the thread for local transfers, talking to local senator offices for help i came to know that its few more months delay. Thats it.
Just relax buddy.
