Wrong AD in Newspaper

Our lawyer placed a sunday ad in The Journal News, which we had decided not to use due to cost. Realizing the mistake, she said we will disqualify candidates coming from that newspaper. My questions:

1. How do we knof if a candidate comes from The Journal News, as opposed to The New York Times (where we also placed ads)?

2. Is it legal for us to disqualify candidates because of a misplaced ad?

When you submit resume, in the cover you write where you saw the ad. It is kinda standart for a job application. So you will know. I don't know though if it is legal to disqualify these canditates.
