Worried....9/98 ND

Looks like I\'m the only pre 9/98 ND case still pending at VSC. I\'m surprised that VSC is claiming to be processing 3/99 ND cases considering there are still many 98 cases pending. My lawyer called them on 6/5 and was told that it\'ll be 6-8 weeks before my case is approved. My FP was done in 4/99 so it\'ll expire in about 2 weeks. I\'m not sure what to do. My lawyer refuses to notify VSC that the FP are expiring and request them to have the case approved before that happens. I\'m not sure what to do except to wait till 6 weeks after 6/5 and call them up again.

Does anyone have the fax number for VSC? Is there anyone else with ND before 10/98 still waiting?

VSC has been processing cases whose FPs are expiring very soon to avoid a Re-Do. I would strongly suggest that you (if your lawyer is bad) talk to an IIO and mention FP expiry date so that they can move the case. Unless your attorney is very good most likely these issues should be pushed by you alone. Good luck

My Suggestion is have attorney send a Fax about FP expiry. INS should give your case priority attention.
It must be real frustating for you, isn\'t it? Anyhow hopefully soon!

How about going in person to VSC and requesting them to adjudicate your case due to fingerprint expiry? Go armed with employer letters, tax forms and other goodies incase they want additional evidence. Is this realistic?

I strongly suggest to not to go to VSC personally, I have been there and didn\'t get much help other than loosing $1000 on my trip. They are good at listening to what ever you say to any length but, they are good at saying we cannot help you. More over you don\'t have direct flights to go there. The closest is Manchester NH. From there you have drive for another 3 hours. The closest big place to St. Albans is Burlington which is about 20 min dirive. On contrary, this is really a good time to see both Vermont and NH. It is really scenic and very beautiful.

In my opnion, Going to VSC will just add to your frustation! Take it calm! Even with new FP..it is another 2 months.
waited so much,,,prepare wait for another 6 months! use your valuable time for some interesting and useful things
as you will never get the valuable time lost in this wait..! (you will get money once you get GC)...

Thanks for all the responses. I did ask my lawyer to fax the INS a notice, but she said that she didn\'t have the fax number nor does her firm make fax inquiries. I would like to do it myself if I can just get my hands on the fax number! Does anyone know?

I have never called the number during the time IIOs are available because I\'ve never been able to get through. Any tips on when to call? It is very frustrating and scary, because I\'m wondering why all the other cases have been approved except mine. The funny thing is that my case is probably one of the most straight-forward case: I\'m single, no dependent, all university education was in the US, lived in the US since age 14 so no security issue there (no need to get clearance from foreign country). I think I just happened to be assigned a lazy officer. *sigh* It\'s Morphy\'s Law isn\'t it?......:-(

FYI for those of you concerned about FP expiration:

I spoke to my lawyer about my case, which is very old (9/98 ND). I was concerned about my FP expiring in less than two weeks. She told me not to worry because none of her other clients with old cases and expired FPs were requested to redo the FPs. She said that medicals expire in 12 months but INS never asked anyone to redo the medical. As a matter of fact, according to her, if we notify INS that my FPs are expiring, it might force them to ask me to redo my FPs. In other words I should keep my mouth shut and hope for the best.

They called INS about my case last week and again it was 4-6 weeks. I\'m beginning to think that maybe they\'ve adopted a new policy of approving cases according to the Priority Dates instead of Notice Dates. My PD is 11/97 so that might explain why people with 4/99 ND but much earlier PDs are getting approved before me.
