A quick question? Can a person work without any problem if his I140 gets approved and I485 gets pending more than 6 months with BCIS?

He does have an EAD and has H1B also, but is it risky to work on EAD with I140 approved??

Will there be any queries on I485 approval time if he works on EAD at the moment??

EAD is meant to be used for employment. I am not sure what exactly other usages do you see for having EAD?

I mean working on EAD even though I have a valid H1B as I can eliminate a layer or two layers above me, to get a better billing rate. Is there a problem if I start working on EAD and get a query on 485 at the end before the approval??

What are the pro's and cons???

Pros:
1. You will get richer(better rates more money).
2. You will not eat up H1b visa time.
Cons:
1. You will need to get in queue for EAD/AP every year (mark it as birthday).
2. Any problem with 485 will increase your heartbeat. A denial of same will force you to leave USA before next dawn! :D

Use EAD - what is life without a feel of using EAD and AC-21(you will not get any second chance to use it in your life once this stage is done.)!

On serious side: I would suggest - go for EAD if 140 is done. There will not be any issue with EAD if there is just a query on 485.

- using EAD would not cause any RFE on I485, though there are other reasons.

- Send a letter to BCIS about a change in the employer(AC21)

I guess by using EAD he means he wants to change employers and be on the payrole of that company (get a W2). I am not sure if working on EAD on 1099 is advisable. You have to be employed by an company and should not be self employed (On 1099).
