Hi I have filed 140 and 485 together in july 2003 my EAD was approved and i have started working on EAD since may of 2004
3 months back i got RFE on 140 requesting company' s tax returns and they have submitted all info, now uscis rejected my 140 and all other pending cases along with my wifes cases on basis on Company's inabilty to pay.
actually i have valid H1 till 2006 since i have started working on EAD i guess my H1 will become invalid
now what will be the next step ? , I still have to talk to my lawyer about appeal, they said they will appeal for it.
some body said if i go out of country on h1(let's say to Canada on tourist visa) and reenter with new I94 my H1 will be valid again , Is it true ?
